I'm pretty sure they are Western Toads but they are so small its hard to tell. It shouldn't be too hard to catch one but they do look similar to that one pictured above.

Okay i just caught one. Yeah i thought so. Western Toads...I failed to mentioned there is a small ''pond'' (no fishing of course) right next to my house. I have caught a large number and let them go out there.

I work with amphibians for a federal agency and in this state we have to have a collection permit to take any amphibians except for bullfrogs. We can't even take gamefish without a collection permit. This is why I questioned it. I'm suprised CA will allow the take of all those species (except for those that are non-native then I can see why). The pet shop suppliers must have a field day down there.

Not really. There are strict regulations on what they can possess and sell. The only native species that are legal for a pet store to have, sell, buy, or breed in California are captive born rosy boas, gopher snakes, and king snakes, though there is an added exception for albino/amelanistic specimens of any species. If a pet store gets caught selling native reptiles in California, their license will be revoked, and the owner will face criminal charges. That's not to say that some don't do it anyway, but that's a whole 'nother story. Peace out.

Yeah that's what I'm talking about. The fact that you can take and posses those with nothing but a fishing license is pretty strong encouragement and makes it pretty easy for the taking of more than the legal limit and reselling in another state.
