This is a post from another message board I visit from time to time. I don't know what state this is in so laws are going to vary:
"So, I went hunting this afternoon. Saw a good number of deer, but no antlers. On my way home, a car infront of me hits a deer. They stopped, and I pulled over to see if they needed help. They were okay and calling home. The deer was laying in the middle of the road, flopping around a bit, still alive, but obviously hurting and definitely not going to make it. On top of that, the thing is still in the middle of the road. If someone comes along and swerves to miss it, they could hit us or one of the many trees and hurt themselves. So, I go into my trunk, load one round into my rifle, and put the poor thing out of its misery and dragged it off to the side of the road. I stayed with the guy (older guy, say near 70) until his ride and the tow truck arrives. Right behind the tow truck is the local DEC officer. He takes a look at the deer, and wants to know what happened. The old guy tells him, then the DEC guy asks me. I tell him what happened as well, the whole thing. THE SOB THEN PROCEEDS TO WRITE ME A TICKET!!! He gave me a ticket for killing a doe without a license, at night, while travelling with a loaded weapon in my car (which is completely untrue, I NEVER do that, and didn't this night, and he wasn't even there to know). So, I'm facing like a grand in fines, loss of hunting license for 5 years and legal fees because I tried to do what I thought was the right thing. He took my hunting license, so I can't hunt for the rest of the year, or fish, and I have to wait until Monday before I can even call anyone about this. I guess the good news, if there is any, is that he didn't take my gun and car.
Sometimes, the law is just plain stupid, and the people they hire are even worse."

Wow, that is completely bogus! Didn't the DEC guy see the damage to the other car? What about the drive of the other car, did he not corroborate your story of why you dispatched the deer?
I hope the judge isn't as anal as the guy writing the ticket, and that you got the name and address of the party who hit the deer in case you need a witness.
Good luck, and it will make me think twice about what to do if the situation ever arises!

in Fl. we have deer hit every day and they are shot by most anyone with a weapon if need be with the blessing of the wardens.
the road I live on is only 4 miles long and we have 2 , sometimes3 a week hit and we just finish them and load them to skin, the wardens will even help load them.
it is also aginast the law to shoot across or over a hwy. but they overlook it in the case of dispatching an animal.
I just hope this guy gets the chance to tell his story to the judge, and the man that hit the deer will be with him also.
some wardens are just gun ho and want listen to reason.

Eh, I managed to get 3400$ worth of damage on my truck when I had a doe jump out in front of me. There was a game warden behind me, and a cop came as well and get all the paper work filled out. My dad came to pick me up, and asked if we could take the deer for the meat and all, but the game warden said no, saying it wasn't in season and that he'd deal with it. At the time I really didn't care, but that deer sat there on the edge of the road until it had rotted away...Go figure.
