As for the level ground arguement, on perfectly flat leve ground, most every deer caliber would hit the dirt 300 yards behind a deer size target.

None of us knows all the facts. we weren't there. Lets look at what we do know. The bullet was intact and was not a ricochet. We also know it was not an unintentional discharge. The victim was in the line of fire. The distance and the bullet drop over that distance indicate that the shot had to be at an uphill angle. Otherwise it woukld have been in the dirt long before it got to the victim. Maybe it was a horizon shot as someone stated here, maybe not. Anyone shooting up a hill has to be concerned that the bullet could travel beyond the horizon. One poster here has said many times that this area is highly populated and should be shotgun only. The hunter should have been extra careful with this type of shot in a highly populated area. the bottom line is, this lady got shot and we know what gun the bullet came from. He was therefore at least somewhat negligent and at worst grossly negligent. I dont think any one here believes it was intentional.
Disparging the victim with statements about her personal life that have no bearing on what happened is a tactic generally resorted to when someone needs to distract everyone from the real issue. Cheap shots arent going to take away the fact that this guy shot her and bears some responsibilty.

I did take notice that you never did answer the question. Im gathering that since you didnt responsed, that youve shot at deer on level ground, and could very well have shot someone behind the deer.
I'm not sure who your question was originally directed at anyway.

This one
To any and all of you who continue to rationalize and defend the irresponsible behavior of this slob.....Would you argue on his behalf if the owner of a property you hunt or hope to hunt was present?

First of all Im not arguing on his behalf, Im saying that this kinda crap happens. And second yes I would as a matter of fact. Most of the places I have permission to hunt, I know these people and they know that sh!t happens.
Now you going to answer mine?

The fact remains she is trying to profit from an accident, if she wasn't there would be no suit. That alone speaks volumes as to what type of person Ms. Burns and those whom support her are!

you're exactly right--maybe you should teach an online safety class to many here---a preponderance of ignorance doesn't outweigh a grain of common sense--unfortunately, it seems common sense is not that common

hillbilly please explain to us ignorant folks just how you can be ABSOLUTELY SURE where that bullets is going to end up after it leaves your gun.
I once was standing in my barnyard shooting a hog not 5 ft away with a 22 LR. At the shot a window broke in a shed 25 yds away and the pig was dead as heck. Bullet went in his skull and glanced off came out and hit the window. Under your theroy i was intent on breaking that window.
