definately sounds like a scope problem. Though rare, you do get bad ones.
I wonder if the bonehead that put the scope on screwed it onto the front ring and twisted it into the mating slot. You're spuuosed to us a 1" dowel to set the front ring.
Cour have bent the scope or even cracked the scope tube
