Set up yards from an area where recovery is not allowed is accepting the fact that you may not recover a deer.
Certainley no grounds for being surprized, shocked or crushed.
Possible outcome was known prior to dropping the string.

OK, keep hunting there. If you lose another deer to this guy, that one is on you. You know you don't have permission to recover a deer on his land why continue to hunt there and take the risk? Move away from the property line so if you get a shot you have a better chance of the deer falling on your side of the line. If you hunt out of the same stand and lose another deer that crosses the line, well, YOU WASTED THAT ONE!

First of all that really sucks. I was under the impression that game wardens have almost unlimited power when it comes to animals being killed, possessed, etc...

My question is of legal possession. If this guy is an anti-hunter, he would not have a deer tag. However, he now has a deer in his possession. If he does not have a tag and he does have a deer in his possession...I would call the game warden again and tell him this scenario, then ask him about the laws of poaching and possessing an illegal deer. In Michigan you cannot even remove a deer from a car accident without a road kill permit from the police or you’re subject to fines. Sounds like the game warden had probably cause to enter the property as he and the State police were called to the scene and saw the deer. If the guy did not have a tag or want a road kill permit, then you would think the game warden would confiscate the animal.

It always brings up the idea of possession. You have have a legal State endorsed tag / ownership of that animal. I realize property rights, but if my kid or dog ran onto your property are you going to keep them too and not let me go get him? I would have went and got the deer even if the DNR took it.

Sorry it happend. My father always said that no matter where you go and no matter what you do, 5% of the people in the world are A**holes. Unfortunatley, all we can do is avoid them.

Call the game commission and report him for poaching. The deer was dead on his property as witnessed by the law and game commission. Where did the deer go? It didn't get up and walk off. So if he moved this deer with out being properly tagged, he is in violation of the state game law and can be punished by law.


Or you can always dump a bunch of raccoon urine on the property line. With the right wind, he will be hating life. That is some of the worst smelling stuff possible and they can't prove a damn thing.

At this point, the best thing you could do is talk to a lawyer quick, and see what your options are. Become an expert on the law in this area. I would focus on the landowner moving the deer without a tag, you may be able to put him in hot water and cause him a whole lot of stress. He may want to relieve the stress and give you the deer so he doesn't get fined himself. If possibleI would try to ambush those deer a bit further back so if you shoot another one, it has a better chance of expiring before or closer to the property line. Good Luck.

The land owner did not kill it,he was not hunting.he has no responsibility to tag anything. He found a dead deer in his yard, same as a road kill, cwd or any other form of death.
He can dispose of it any way he wants.He would need a permit if he wanted the meat and pay a cost to PGC if he wanted the horns. In this case he wants nothing but to deprive Tim of his buck.

Update is...I seen 9 buck from this stand in 2 sittings this week! i will be on the stand in the a.m. I am not giving up. This was the 1st deer to ever run in his yard! Usually they run down thru the woods and cross over his property and I never have a problem cause I go around his land. I did have a few die down at the creek (on his land) down over the hill away from his house I just grab them and drag them over to my land! I have all the right in the world to be where I am at! As for the deer I have no idea what he did with it? The authorities have my number and they never called so they don't have it or I would of got it! I will call them today and ask them about him moving the deer,but I ask the game warden I said So that deer is gonna go to waste he said yep i assume so, he has to give me permission to get it!

Don't get yourself in trouble with the law. Even simple things can lead to them not renewing pistol permits and such.

Around here the plowman would be quite pleased to pile snow at the end of his driveway. You can keep him trapped for the winter.

I still see that he is in the wrong for moving a deer that has no tag. Even with road kill, you have to get permission to move it. Its not just some trash that was tossed in the yard. I wonder if a deer would just drop over dead in his yard, would he remove it or call the game commission to come get it? Not starting an arguement here Jim, just trying to think out loud.

You have to get a permit to possess a deer, I drag road kills into the woods for coyote baits when ever the opportunity arises.
Trespass laws are a civil matter and the P.G.C. has not a say. You must call 911 and have them prosecuted in criminal court.
If called to dispose of said deer they warden can give toa needy family if one is near by or the carcass is taken to a local deer dump.[:@]
