Actually, the second situation is not tresspassing. A hunter has the legal right to recover their game. The landowner has no legal right to prevent them from doing that...call the cops, I will wait. haha.
Depends on your state laws - no right to recover without permission in NY.
Landowner has the legal right to deny access - even with a CO.
I have done so because of prior abuse by some hunting our borders.
Most have permission but there are some that will be sited if they trspass for any reason.

................but I remember a time and a place where you could count on a total stranger to render assistance to someone in need. People waved "hello" to total strangers they met on the highway. I joined the Navy in 1981 when I was 17. Now, I've seen more of the world than I haven't seen, and I've never seen anything to change my feelings thatwe, as Americans, are the luckiest people in the world. We have rights and freedoms that people in so many other countries can't begin to fathom, and so many Americans take them for granted, take advantage of them or just generally spit on them.

23 pages of debate, who has changed their minds, really curious.

What I have come to realize as a result of this discussion is because I may choose to recover a deer on posted property at significant distances from anyone's residence or buildings it is effectively the same as me entering their home without permission. In a million years I would have never thought that the two things were considered in the same manner. So being the heathen that I apparently am I will now begin to enter peoples homes at will to quench my thirst or to make a sandwich use the bathroom what ever my needs dictate.(NOT)
My sense of ethics are such that when I squeeze the release while shooting an arrow or pull the trigger while firing a rifle I will not rest until I have recovered the animal that I have shot or determined that I havn't hit it lethally.
I have never had to trespass to recover an animal,I have neverset up near another hunters property line.My sense and hope of human nature is that anybody whose property I haveentered or crossed to trail and recover a wounded animal would respect my diligence to do what I believe to be right and respect that I either didn't want the animal to suffer unnecessarily or that I wanted to make use of the animal versus leaving it to the predators.
I understand the points made by Big John,Bawana Jim.SteveB etc..If I had hunters who were hunting my land when told not to,or were poaching on my property they would get no consideration from me.But for the guy or gal who entered my property to recover an animal and who I had never had any difficulty with would get my consideration and help regardless of whether they had asked forpermission or not.Their sense of gratitude and courtesy would dictate what would happen in future situations.Any thing beyond this is not comprehensible personally to me!
I would be willing to take my chances offering explanation to a landowner and if need be a judge.

Ok,
I've got a question for all of those who think it's ok to jump a fence and grab your deer even though the property is posted and you know full well the owner doesn't want you on the property..........how far is too far? I really want to know. Where do YOU draw the line? If 3 feet is ok then how about 10 yards? Where isthe point when you say "I shouldn't go there"? I really want to know.
To me if your willing to go 3 yards then you might as well go all the way into the property. Do you believe the last 3 feet, 10 yards (or whatever your threshold is) of a persons property is less theirs because it just happens to butt up against the property you can be on?
I really want to know where you guys draw the line and how you justify that part of the property less important or less privatethan the parts you won't go..........enlighten me.

Kind of like asking someone how far it would be acceptable for their kid to chase their soccer ball into the neighborhood grouches yard. [8D]

Saying this respectfully to the man who likely out weighs me by 100 plus pounds, what part of"I will not rest"is not clear?
