Actually, the second situation is not tresspassing. A hunter has the legal right to recover their game. The landowner has no legal right to prevent them from doing that...call the cops, I will wait. haha.
You have obviously not read much of the thread.
Depends on your state laws - no right to recover without permission in NY.
Landowner has the legal right to deny access - even with a CO.
I have done so because of prior abuse by some hunting our borders.
Most have permission but there are some that will be sited if they trspass for any reason.

I guess this is where I get mixed up w/ this thread. I thought it was "Ethics" of the situation, not "Legality" of the situation. I'm also a little confused about why it's either trespess, or rot for the deer? As I stated, why can't you go try to smooth over the issues with the land owner and CO, and if you can't, at least assist them in recovering the deer that you shot, so it doesn't go to waste. If you at least ask, it would go along way toward easing the tension later down the line, and maybe even becoming friends. I surly wouldn't go there and challenge the merits of his case, or even argue the merits of fair chase. I would however, enlighten them on your true concern for your "ethics" of recovering the deer by either party, so it doesn't go to waste. "Ethics."
