Well since it happened the owner and the dog haven't been home since. I do feel bad for the guy because he is old and comes to my football games and stuff but he shouldn't of brought that dog on our property.

Things like that happen. We've had stray dogs in our yard. When we see them we just don't let ours out.
If the dog attacked your chihuahau before, maybe you should have put your dog back in. I know it was your yard but you should have been more careful. An ounce of prevention is worth a pound of cure.

If you kill that dog, (and it probably deserves it) you may start a warthat could put your own dog's in jeopardy.
Talk to the neighbor about your bills. If he doesn't quickly make right financially - sue. You've got to be a lock (unless you retalliate) for damages, pain and suffering, court costs, etc.
(for the record - I don't think I would have been able to write on this forum tonight if my two dogs were injured because I would have been wearing police issue bracelets after I beat the tar out of the guy.)

I must be crazy because that dog would have never made it off my property!! Somone posted earlier that it is felony to shoot a dog but i'm pretty sure you could choke the life out of one fairly quickly and use the old faithful "He was coming right at me!" defense. You definitely still need to contact a lawyer in reference to reimbursement on the medical bills. You stated that you have a little brother and if there are other kids in that neighborhood someone needs to protect them before the next incident. Call Don Lito and get that dog whacked!! J/J but not really.

In reality, it would be very very very wise of the guy if he took the dog to the vet and had it take a long nap without anyone saying anything to him....If he isn't that smart, I personally wouldn't let law into it, I would take it into my own hands and there would be posters hanging around for a "missing dog"
I've had this happen to me before, only it was my dog that did it. When I was around 10 or so the neighbor girl, and a few others were at my place playing basketball. My lab loved to try to steal the ball, etc. And he jumped up and his dew claw left a scratch on the neighbor girls back. She went crying home and told her parents that my dog "bit and attacked her" next thing you know he pulls in the yard, puts the 22 out his car window and shoots my dog at point blank range right in front of me. Her cat disappeared a few days later.......Never did find out what happened to it

However, I know in Texas there can be legal and civil repercussions if you shoot your neighbors dog wether it's on your property or not. Like the one guy mentioned, get the police involved, get the dog on public record andTHEN keep a rifle handy for the next time he wanders over and "attacks" you.
Oh, and for the record, it really bothers me that an "ethical sportsman" suggested glass hamburger and anti-freeze... Antifreeze can take a week or more for the animal to die(I know this first hand), glass in the hamburger probably just as long. What makes a deer any more deserving of a quick death than a dog, regardless of the dog's actions?

The dog is violent and attacks people, I don't care how it dies. Dogs have died for a lot less than this. Had it been closer to home you might not be as concerned for the dog. This story although bad could have been worse(small child playing alone). The glass/antifreeze seems sneaky and i don't agree with that method. I prefer a straight forward approach gun, bow, knife, hands. Quick and to the point, then tell the dog owner what happened and why, nosneakiness.For the record no deer has ever attacked my chihuahua or my mom.

If he's been a neighbor for awhile approach him about paying the bills if that doesn't work get the law involved. I would also request that the dog be put to sleep.
