Elite vs Bowtech court ruling

Well we disagree here. If a judge tells a company they can only sell the existing product untill August 31st and then must market a new line and then puts a bunch of "appearance" type conditions on the new product then I wouldn't expect a new line too soon from elite. If they can pull a new design out of a hat then they would have anticipated this ruling and were prepared for it. If I was Elite I would appeal this as the conditions are so far reaching ( even limb angle + or - 3 degrees ) alot bows look alike and probably are violating this judge's ruling. I wonder if it will stand on appeal. But, that could take a long time and money spent on lawyers and not R&D or inventory. Hey I think they had a great bow and would likely have bought one after the company had put down some roots and could honour its warranties, but even though I'm not a lawyer I am in business and understand what is involved in creating new lines and getting them to market and that ruling is a major body blow.

My guess is.....if Kevin can can design the Bowtech line.....I am most certain he is capable of designing another. I'm in agreement that this sounds bad, but again, until I hear something "Official", which doesn't include a post on an archery forum, by the way, I'm just gonna wait and see what happens. Does sound pretty bad though.

This is not a bad thing for Elite, this is a good thing IMO. They basicallygot offwith only a slight slap on the wrist. (just like BT did with the PSE ruling.)
1) They won the non-compete outright. This means that they do not have to pay the big bucks to BT coming out of the blocks, IMOthe killing stroke thatBT was looking for.
2) Key word in the rest of it is "appearance". Appearance can be changed (and defended in court) as subtly as by changing color, cutouts in the riser, rounding of a cam lobe or changing cutout structures in the cams, installing a e-suppressor at the factory to go out with every bow, etc. They should IMHOchange the ATA and brace to get away from any closeresemblance to the BT's, but that is a very minor change too-- all they have to do is run the limb pocket angle oh, say about what, 3.5- 4 degrees different? [8D]
I think that is why they (Elite)are so happy. They can continue on with little trouble from the looks, withfar less hasslethan what they originally thought anyway. Appeals are a naturalpart of the court system, and I'm sure some have already been filed. Personally I think this is all going to go away within a few months(or years)and both companies will continue on pretty much as they are. We'll just have to wait and see.
