He Had No Choice?

Default He Had No Choice?

Two months ago in November my brother was hunting on our family's property. We hunt together often but that evening I had to work. About an hour in his tree stand out in the middle of the woods the nieghbors dog, a Rottweiler, come trotting by. This is one mean dog! He spotted my brother up in the tree. He barked agressively at my brother for 30 minures or more. My brother yelled out in hopes that the neighbor was somewhere in the woods within earshot but he wasn't.It is beyond me why the neighbors aloud this dog to run free.Anyway my brother yelled at the dog and tossed his grunt call down at the dog hoping to run him off but it didn't work.So after about another 30 minutes my brother climbed down thinking this would run the dog off. My brother was on the last rung of his ladder when the dog struck biting him in the back of the thigh. My brother quickly climbed back up into his stand. At this point he felt he had no choice. This dog was not going to let him out of his stand. My brother took a steady aim and placed an arrow through the dog's vitals. The Rottweiler was dead in less than a minute. My brother took the dog's body to the neighbors house. The guy wasn't home so my brother explained it all to the neighbor's wife. She told my brother that it was OK and she understood he had to do what he had to do. Well, today my brother finds out that the guy is suing him for killing his dog! I support my brother's decision and I told him in the same situation I would have done the same thing as he did. How about you? What would you have done?

I have never killed a dog before. But if a dog bites me he is dead. And I would try not to even let the dog bite me first. Your brother did the right thing. The court will throw out the lawsuit if he was hunting on his own families land.

i support your brother as well. This dog in my neighborhood almost killed my dog by biting him and bit my neighbor in the face and bit his own daughter and we have filed restraints to keep the dog locked up. We live out in the middle of nowwhere where most dogs run free. My dad told me if im ever hunting and see the dog to shoot him if he comes near me. I dont know if i could do that but if it was a threat to me i might.

I'm suprised the lawyer even took the case if he did or has your brother been served ? You should carry a liability policy on your land its fairly cheap and covers things like this.LOL

According to everyone in here, that dog should have been arrested for tresspassing right. Still shooting the dog is against the law and we'll have to report that. Good citizens right. I hope your brother is alright. No hard feelings, just proving my point further

Shooting a dog in self defence is not against the law.The dog had already attacked the individual and was still posing a threat to him.If anyone is liable it is the owners of the dog.Too bad it wasn't janc up the tree as I would have enjoyed watching her climb down and make a citizens arrest on that dog.

I may not have even went as far as climbing down the ladder before I let my arrow fly. This is a clear cut case of self defense.

he did right.file on the guy for the medical bills,pain and suffering.
he may change his mind.

I think he did everything possible to try and scare the dog off.And he even got bit trying to get out of his tree stand.I have never had to shoot a dog before either but you can bet I wouldn't be staying in my tree stand all night or untill the dog decided I could get down.I think he did the only thing he could under the cicumstances and he did take the dog to the owner and explained to him what happened.If anyone should sue it would be your brother for letting a dog run on your property and ends up biting people.
