Default He Had No Choice?

Two months ago in November my brother was hunting on our family's property. We hunt together often but that evening I had to work. About an hour in his tree stand out in the middle of the woods the nieghbors dog, a Rottweiler, come trotting by. This is one mean dog! He spotted my brother up in the tree. He barked agressively at my brother for 30 minures or more. My brother yelled out in hopes that the neighbor was somewhere in the woods within earshot but he wasn't.It is beyond me why the neighbors aloud this dog to run free.Anyway my brother yelled at the dog and tossed his grunt call down at the dog hoping to run him off but it didn't work.So after about another 30 minutes my brother climbed down thinking this would run the dog off. My brother was on the last rung of his ladder when the dog struck biting him in the back of the thigh. My brother quickly climbed back up into his stand. At this point he felt he had no choice. This dog was not going to let him out of his stand. My brother took a steady aim and placed an arrow through the dog's vitals. The Rottweiler was dead in less than a minute. My brother took the dog's body to the neighbors house. The guy wasn't home so my brother explained it all to the neighbor's wife. She told my brother that it was OK and she understood he had to do what he had to do. Well, today my brother finds out that the guy is suing him for killing his dog! I support my brother's decision and I told him in the same situation I would have done the same thing as he did. How about you? What would you have done?
