Yes the ban did sunset. Some stateshave their own whiney anti "assault rifle" laws. Some not so honest dealers are selling what they call "pre-ban" magazines at a premium in order to take advantage of ignorance by some shooters of semi-automatice like the AR-15.

Be careful! There are legal versions sold in NY but in spite of the Federal sunset the State of NY has kept the restrictions in place.
New York's assault weapon law (modeled after the now-expired federal assault weapon ban) provides that it is a class D felony to manufacture, transport, dispose of, or possess an assault weapon in New York. N.Y. Penal Law §§ 265.02(7) and 265.10. New York’s assault weapon ban does not apply to the transfer or possession of assault weapons manufactured before September 13, 1994. Section 265.00(22)(e)(v).
An assault weapon is defined by section 265.00(22) as:

A semi-automatic rifle that has an ability to accept a detachable magazine and has at least two of the following characteristics:

Thanks sierra6. I was gonna post that. I have heard rumors about ATF agents that go to gun shows and grab dealers for selling "no ban" guns. The worst part is they wait for someone to buy it so they grab the buyer and seller.
