I don't know whether this is right place to ask this question. A friend of mine got into some trouble back in middle 80's and was sentenced and convicted of theft. He was put on probation for 3 years and pardoned in 1990. He said he had all the paperwork that said all this. He went to purchase a hunting rifle and when going through the NICS check they delayed the purchase. I told him I'm not even sure he can buy a gun anymore. Seems to me if you have "DONE YOUR TIME" and the offenses were of the non-violent nature that he should be able to purchase a gun. Does anyone have any opions on this matter?

This removes the record.....more likely you mean he was released.
To be put on probation is the same as a guilty verdict. This is a felony and the laws are clear.....
The rules for buying a gun ask about felonies.....not violent crimes.

He was pardoned by state of La. I think I found what I was looking for. Read on the form 4473 that if he was pardoned in the jurisdiction where crime was committed and his rights have been restored then he would answer the question --have you ever been convicted to a felony--answer it no. So I assume that he should be able to buy a firearm. Sure is a lot of fine print in all that stuff.

I don't know. I hear of folks who killed people when they were children now able to own a gun. Thats bull. Theft? I don't know. It sounds like a felony.
I know people who learned to be a real criminal in jail and was doin thier time. For your friend, my opinion is why not. Never heard of a Governor taking the time to pardon a theft conviction but stranger things have happened.
Just venting here. The rule I hate is a woman can say you assulted her and they can take away your guns. My ex-wife found out this tidbit. And sat there afterabandoning me, with a big smile on her face and said, "you know, if I want to, I can take away your passtimes, I can ruin you, I can live in your house your paying payments for, and you can't come in". So 35K later, she said she was sorry. That was wrong. She appoligized for saying that. I was scared to death.

The "pardon" idea is a new one to me, I have never dealt with a person who was pardoned! Was this an executive pardon granted by the Governor of the state, or the POTUS?? If so, the question now becomes "did this pardon completely wipe outthis guys's felony conviction, as if he were never convicted of anything in the first place? If so, he needs to get an attorney and have the state's conviction record expunged! That way, the next time NICS does a check, they will find nothing!
If his "pardon" was not a complete, unconditional one, he needs to apply to the court where he was convicted to have his right to own a gun restored via whatever mechanism Louisians has set up for such things.. This then would be up to the judge of that court to decide!

He can apply to the government for special commit to purchase a gun but these are very few and far between. And for good reason. A person who commits a feloney knows exactatly what they are doing and did the crome anyway. Now that time has passed and they did time they feel like they shoud get everything that people who have done the right thinig all their lives shoud get. I work in a prison and have for 12 years I see just how sorry these folks aren't. And how they scam and sneak and try to get away with anything they can. Plus lie hit each other and say we did it they think there is nothing better then try to screw a guy who does the right thing and make him loose his job. And yes folks its all of them not just a few. And the worst part about it is that the adminstration belives them more then us all they have to do is say it and they the convicted felen is belived not us who are mostly all military vetrens and never comitted a crime in our lives. Sorry but thats the way it is, NIce huh I wonder as I sit back on this vetrens day and remember those vetrens who gave all if they would still do it if they knew how this country would be today. I'm sure most would say no. Now make sure those borders stay open. I fly my flag at half mast for more then one reason today. And as I drive around most folks who fly the flag don't even know to fly it at half mast today. Or the flag the fly is old ripped and faded which shows me they really don't care at all. I'm sorry most of the men I served in battle with did not make it back I myself was a POW in Viet Nam for 18 months and days like this make me think too much I guess.

Mike I am sorry but you need to let it go, I to was that for over 19 months of pure hell and when we came back we were the bad guys we were the baby killers. They did not care then and they don't care now a lot of are freinds did not come back from over there it was a war that washington did not want to win and we paid the price for it. I like you will fly my flag because we now what it stands for. It is to bad the rest of the people don't, or what it would be like if we did not die for the red white and blue for these color don't run and they don't hide Thank God for the red white and blue.

According to his letter he was pardoned by the first time offender pardon in Louisiana. Ironically he has purchased two guns at dealers since 1990. An according to the BATF form 4473 anyone that has been pardoned or case expunged is elgible to purchase.
For Mike and Ren, sorry you guys went through what you did. It was tough as I was in Nam for 18 months and seen some of the things going on. Our political leadership to me was afraid to win that thing.
