I have encountered this exact scenario before.

First, I don`t want/need anyone elses treestand.

Second, I would/did take it down.

I pinned a note on the tree explaining where the stand could be picked up.

Some people tend to take tresspassing lightly.

Like Big Country, I won' t steal someone else' s treestand. However, I have been asked by one of the landowners to remove any treestands I find on his property. I removed an essential part of the stand and placed it nearby causing an intense search if he wanted to find it. The rest of the stand was left at the bottom of the tree (and was gone the next time I was there).

My rationale is: this poacher was breaking the law by hunting there and he' s lucky to not be explaining himself in court. He may get even luckier if he finds the missing part. The stand is not broken or hurt in any way and can be made useable again by replacing the missing part or fashioning a replacement.

I would definatley let the trespasser know he has been caught. The last time I had this happen I took 3 no trespassing signs and tacked them to the tree and tree stand. Never had a problem since.
I wouldnt just take the stand for my own for the simple reason that the person whom it belonged to may try to seek revenge or compensation by stealing or damaging something of mine.

I would pin a warning note on the bootom of the tree, and would put something in the stand such as a branch or something to make sure there was activity. I have found stands on my own land and have done the same thing. I always give a warning and make sure that the person has read it. If it is still there after that, down it comes with another note letting the person know where they can pick the stand up.

Got that right, and very good point. Especially if you are dealing with a secluded area.

Ditto on Big Country' s response except that after a season, if the stand isn' t claimed, then I would consider keeping it...or at least using it on that particular property.

I would take down the stand and leave a note stating that you are trespassing and if you want your stand its at my home and leave an address. I would also reassure the person that I am not pressing charges this time but I would like to meet them face to face. That way if I see them again on my porperty then I know who they are. If a substantial amount of time went by maybe a year or so and no one came by then I would keep the stand.

No I would not take the stand, but I would leave a note saying that the owner has been advised.
