I would definatley let the trespasser know he has been caught. The last time I had this happen I took 3 no trespassing signs and tacked them to the tree and tree stand. Never had a problem since.
I wouldnt just take the stand for my own for the simple reason that the person whom it belonged to may try to seek revenge or compensation by stealing or damaging something of mine.
