The "RIGHT" answer is this.....
Don't do anything that would compromiseyour ethics.

Jeff, if you can not posativly ID your target ethics say DO NOT SHOOT! By stating that you dont know if this animal has antlers or not tells me you CAN NOT POSATIVLY ID you target! So I guess i am holier than thou. This is a bad shot bottom line!

I love how people can jump to conclusions.
My set in the morning will be in a pine.....about 25 feet off the ground. When the leaves fall off the trees around here.....you need SOMETHING to give you cover. If I get high enough into the pine....the foliage from the branches will offer me the best possible cover scenario.
Oh yeah.....there's NO limbs below me. NO chance at a "twig" being overlooked to "get" my arrow.
Who said I couldn't positively identify this animal. I've already stated that it's a deer. About now....the sex of this DEER doens't mean that much to me. It's a mature DEER. I have a tag for antlerless or w/ antlers. NC has no antler restrictions.
If I shoot it.....I'll send you a picture.

Dude if you cant tell if it has antlers you are not posativly id it! Bottom line! I hunt in pines they have limbs! Other than that I give up shoot the deer (not stating buck or doe, cause we dont know what it is) have at it. This will be the next post "lost one this morning I "think" I hit it to far back!

You guys are getting hung up on the antlers when it's not an issue. You should have worded the question without mentioning the antlers, some people here are antler crazy.
He has tags for both, he doesn't care if it has antlers or how big they are, so why should it matter if he can identify them?
Now if it's too dark to tell if it's a deer or not, that is a different story. It would suck if you accidently shot someones pony or mule that was loose. I have been in the situation you have been in though. You can for sure make out that it is a deer, but because of the fading light and the background it is hard to make out the rack.
I guess it's up to you in the end. Let us know what happens if/when you kill it.
