Default questions about bear hunting

I live in NC and it is legal to bait for deer. However it is illegal to bait for bear. These two seasons overlap each other. I have several trail cam pics of the bear starting to eat my bait that is placed for deer. It is nothing more then corn. When you buy NC big game tags you are allowed to take bear and deer so my question is if I am hunting deer over a bait pile and a bear walks buy DURING season. Am i allowed to shoot it or is that considered baiting for bear? Thanks
