Those folks that call you and tell you that they may have to come onto your property to retrieve their dogs might also need a place to rest and something to eat. Maybe if they could call your cell phone to let you know that they are also going to intrude into your home for a bit that would be permissable. Hopefully you can squeeze out the sarcasm and get to the point I wanted to make. |

Something I've always wondered what if a guy is on your land, with the states approval of course, and has an accident? With todays lawsuit happy society he could fall or get hurt and you're responsible. But with the dog laws you can't protect yourself from that. So is the state paying the bill or exempting you?

First off, while there has been alot of mudslinging and name calling and high school style drama on this whole subject, not just on this board but everywhere, there are those of us that are serious about finding a common ground that protects boths sides interests with being one sided toward one side or the other. There are issues that do need addressed desperatly and there are some that are being blown out of proportion on both sides of this and if you read my posts on the subject you know I would love to see some changes made as it effects me in a few ways. as a still hunter, as a houndsmen and as a leasee of land. IF you look at this and the other threads from the begining you would see that some of the parties involved (or have a stake in the matter) are starting to stop swinging their sword at everyone else and are starting to try to work together to work to viable solutions.. will these every happen, I certainly hope so but I can not predict the future so I dont honestly know. I do know that there will be people who will work toward this goal, and some that still want to bicker and fight like school girls (and help the anti's cause by showing weakness in our ranks) but hopefully cool heads will prevail. Then there are those who are standing on the outside and just want to throw stones or stir the pot. Maybe they have shortman syndrome or anger managment issues and find an outlet by watching others fight and argue these people are not wanted or needed by any. Such people might as well hold a PETA membership because they are helping to divide hunters which is a PETA tactic. I see that you are from Ok... some great hunting out that way I have heard. I am sure it could keep a man busy with all the chances to hunt out there that it amazes me that someone from out there could keep up to date and be fully knowledgable about issues in other states. If you currently or in the past have held a VA hunting permit(or are a landowner who is directly effected)and have actually enjoyed the wonderful ground this great state has, then please tryto keep from interjecting with a pot stirring agenda in a much heated affair in our state, or any other state that you dont have a legit stakehold in. Dont take it as a personal attack, just take your pot stirring to subject you have a tangible interest. Thanks Justin |

I have to say you have a very valid point (dang is that twice we are on the same page kind of lol) there. I had actually never thought about it, but it makes me wonder too. I would think that somewhere that the state would have thought about this andclosed this loophole. But then again we are talking about those genusis in Richmond so that might be a far stretch to hope for but then again I still believe in the easter bunny too lol.. Justin |

Here you go.............. from one of those personal injury lawyers. Trespasser: A trespasser goes on the premises in question without permission of the defendant, not while performing any duty in relation to the premises owner. Defendants typically have no duty or limited duties to warn a trespasser of conditions or dangers that exist on the premises in question. However, a defendant premises owner may be obligated to exercise reasonable or ordinary care in warning a trespasser if he or she is aware that the trespasser is present on the property in question. |

I am a little confused as to why this post is directed at me. I get the sarcasm, and I understand what you are trying to say, however I think that you may have mistaken my position on the current VA "right to retrieve" law. I think that it is poorly written, and does nothing but encourage law breakers to utilize it to continue. It has no teeth in the punishment department (read this as; there is no consequence for abusing this law) and it violates landowners rights. If you look back at all my post's, not just on this forum, but all the hunting forum's that I go to, you will see that my stance has never waivered. I state that I do not necessarilly want to see anybody loose their hunting rights, but that it is time for change in the ways that those rights are carried out. The right to retrieve law needs to be drastically changed, or done away with althgether. I believe that you should be allowed to hunt as you want (within the law) as long as it does not impact another hunter, land user, or the landowner. Ultimately, it is the landowner who should decide how his/her land will be used. |

It's not so much that the dog hunting laws need to be changed, it is the right to retrieve law that needs to be changed.No one should be allowed on another persons land without their permission. If you can't obtain that permission than do whatI do and wait for your dog to come back. Now I will say if I can see my dog within 20 or 30 yards Than I have went and got it absolutly knowing that I was not interferring with someones hunt in the process.(Istill should have asked).In just about all cases (unless your dealing with a complete as*0) If you respect the hunting rights and lawsof your fellow hunter he or she will almost always let you do just that unless it becomes a badhabit. lol:)

Here they go again.THE SAME PEOPLE who build houses beside air bases and then complain about jet noise.THE SAME PEOPLE who move from the city,buy a peice of property,put up a fence and a gate even before they(if ever)try to get to know their neighbor who probably has lived there all his life,then decide the don't like the way things are so I"ll do my best to change them.They build in the middle of a field and complain about the farmer spraying or plowing the field beside the house.They build beside a hog house or cow pasture,then complain about the smell.They complain about the farmer blocking the road with wide equipment.I don"t see why they don"t just move to a place where people thank like them.Oh sorry,I guess that might mean more jet noise,traffic and murder.I dog hunt and still hunt.If you would sit in your stand a few minutes more until the dogs pass(even if you don" shoot the deer witch most do because its probably the first one they haveseen all day)the woods will shortly return to normal.The deer that is not being run by the dogs will stand and watch them pass and then return to normal activities.I wish you would all move back to the city and quit trying to ruin our lives.
