Any act or furtherance of the taking or killing of any game or wildlife, or any part or product thereof, and includes, but is not limited to, chasing, tracking, calling, pursuing, lying in wait, trapping, shooting at, including shooting at a game or wildlife facsimile, or wounding with any weapon or implement, or using any personal property, including dogs, or the property of others, of any nature, in furtherance of any of these purposes, or aiding, abetting or conspiring with another person in that purpose. "Take." To harass, pursue, hunt for, shoot, wound, kill, trap, capture, possess or collect any game or wildlife, including shooting at a facsimile of game or wildlife or attempt to harass, pursue, hunt for, shoot, wound, kill, trap, capture or collect any game or wildlife or aiding, abetting or conspiring with another person in that purpose. Sec. 2322. Prohibited devices and methods. (a) General rule. - Except as otherwise provided in this title or commission regulation, no person shall hunt, kill or take or attempt, aid, abet, assist or conspire to hunt, kill or take any big game, except wild turkey, with any of the following devices or methods: (2) Any automatic or semiautomatic firearm, except that any semiautomatic firearm modified to permit one shell in the chamber and no more than four shells in a magazine may be used by a person who suffered an amputation or lost the total use of one or both hands. Sec 2308 covers it though: Sec. 2308. Unlawful devices and methods. (a) General rule. - Except as otherwise provided in this title, it is unlawful for any person to hunt or aid, abet, assist or conspire to hunt any game or wildlife through the use of: [ul](1) An automatic firearm or similar device. (2) A semiautomatic rifle or pistol. (3) Reserved. (4) A semiautomatic shotgun or magazine shotgun for hunting or taking small game, furbearers, turkey or unprotected birds unless the shotgun is plugged to a two-shell capacity in the magazine. (5) Any device operated by air, chemical or gas cylinder by which a projectile of any size or kind can be discharged or propelled. (6) Any recorded call or sound or recorded or electronically amplified imitation of a call or sound of any description or any other call or sound or imitation of calls or sounds which are prohibited by regulations of the commission. The commission shall be authorized, by resolution, to adopt rules and regulations authorizing the limited use of recorded calls or sounds or recorded or electronically amplified imitation of calls or sounds when such use is necessary in the commission's judgment to protect the public health and safety or to preserve that species or any other endangered by it. (7) A vehicle or conveyance of any kind or its attachment propelled by other than manpower. Nothing in this subsection shall pertain to any motorboat or sailboat if the motor has been completely shut off or sail furled, and the progress thereof has ceased. (8) Any artificial or natural bait, hay, grain, fruit, nut, salt, chemical, mineral or other food as an enticement for game or wildlife, regardless of kind and quantity, or take advantage of any such area or food or bait prior to 30 days after the removal of such material and its residue. Nothing contained in this subsection shall pertain to normal or accepted farming, habitat management practices, oil and gas drilling, mining, forest management activities or other legitimate commercial or industrial practices. Upon discovery of such baited areas, whether prosecution is contemplated or not, the commission may cause a reasonable area surrounding the enticement to be posted against hunting or taking game or wildlife. The posters shall remain for 30 days after complete removal of the bait. (9) Any setgun, net, bird lime, deer lick, pit or pit fall, turkey blind except as permitted under subsection (b)(3) or turkey pen or any explosive, poison or chemical of any kind. (9.1) Any device which permits the release of two or more arrows simultaneously on a single full draw of a bow. (10) Any other device or method of any kind prohibited by this title or regulations promulgated under this title. [/ul] |

I beg to differ, it's retarded. Either go back to the stone age or allow all styles of rifles, you're legislating a bunch of "could be's", "maybe's", "might's", and "perhaps"..... The ammunition and the hunter are the deadly part of the equation, not the action. ;)

Just as no evidence exists supporting the notions that shotgun slugs are somehoe safer than rifles, no evidence, other than unsupported perceptions exist that semi auto rifles pose any additional safety hazard.
That being said, the law is the law and disobeying it just because it may not be to one's liking is not the way to handle things. If a law is bad, lobby to have it changed. Unless the law is unconstittutional and you have $millions to spend, disobeying the law will just get you arrested. |

I agree 100% that the problem will lie with the operator,not the weapon.Regardless,you don't need to pass and IQ test to hunt so restritions are put in place.

i sent letter into the gun lobbyist here in pa.
if our pistols or rifles are plugged for 3 shots, hey, i could live with just 1 shot,yes, let me use my pistol and just 1 shot. yes, there are hunters that would abuse it and shoot 9 shots at squirreal etc. i heard it in archery season, but could have been a revolver,dont know but i stayed in woods until 1 hr after dark and they still did not come out of woods. next day i looked for deer hair and found none, they may have been hunting coyotes. |

ORIGINAL: DougE I don't think anyone is an anti-hunter just because they feel certain firearms should not be used in every hunting situation.Are you an ant-hunter if you support shotgun-only areas?How about supporting a fafety zone.Is that Obama like?What about supporting a regulation to plug shotguns to a three shell capacity?I personally don't think anyone should be banned from owning a semi and I don't think Coalcracker does either.However,I think their use should be seriously restricted.Multiple,rapid fire shooting is dangerous and unnnesasary.Restrict their use to a single shot and I feel they should eb legal to hunt with.Other than that,keep them on the range. When I would pull MP duty during the Summer of the mid sixties, I sometimes stopped and watch the range for BAR's and the tanks using their machine guns, this I found very interesting and I'm sure others would. Even had to stop traffic for a show of firepower once. You'dreally enjoy watching them firing mortars(sp), machine guns and whatever else they were firing, hard to believe anythingcould live on the other side of the hollow. When I trasferred to HDQT to be Detachment Clerk, we were asked if we would like to firea rocket launcher, naturally I said yes. I don't know if they make left handed ones, but I had to fire it righty. We were alowed three shots, which we duds and you could see them go because they were colored blue. To shorten this story, everytime I fired this thing it would hit my steel pot and cover up my eyes, they told me I never hit the old tank on the other side of the hollow. It was also fun to watch the other guys and see where their shot hit, just don't stand behind hm when he fires it. It sure was fun, but I wouldn't want to carry that thing around the woods looking for a deer. |

If I know couple people that got BobCat tags and I caught couple BCs,I could call my friends up that have the tags and they could legally come down and shoot the catsin my traps since it is considered hunting and fair chase.
Again what is considered fair chase then? A animal that is trapped and held in one place is not fair chase for that animal once caught. That would be considered illegal then to kill under fair chase. Let me trap a deer and shot it.Fair chase I guess. I guess canned hunts in small 3 acre parcels would be considered fair chase and hunting also. Again if it is hunting wht can't some animals trapped can't be hunted on sundays? Legal to trap and kill on sunday not legal to hunt on sunday. No semis,but I am allowed to use a 50 cal BMG if wanted also. Now that is funny. |
