That is a tuff one heckuva a deer but would personally feel like didn't achieve much... I honestly don't know what i would do what is he going through the fence for- shrubbery

Here's a quick drawing of the situation. The city yard is right against the city limit line. Unincorporated county lies to the east of the city. There is a country lane which runs north/south. A flowing creek bed (where the buck goes to drink) is around 200 yards away and just beyond a wheat field. There is a tall cottonwood tree in which a tree stand could be set. From the tree, you have a super view inside and outside the fence. I have seen the buck come through the hole and head Northwest (around the fence). I have also seen him head straight to the creek bottom.

I am a big believer that these deer get this big by living right next to the city where no body seems to look, I shot my deer no more than 1/2 mile from the city limit sign. If you feel that this deer has a fair chance and isn't some pet of someones then yes I think that is ok to take him. Two years ago a couple of rifle hunters chased a giant whitetail from that very same tree belt that I shot my deer out of last year, and he ran towards town in to the state park behind some houses, They didn't get big by being dumb they know what is safe and what is nottt..

Looks like asplendid opportunity for some great photos.Maybe even a disabled individual ,as to the proximity of a road.
To kill itwould mean no more than road kill to me, I am fortunate enough to have wood lands & fields to hunt deer in.
If your adversary is not a worthy opponent then neither is the victory of defeating him.
