I don't quite know what you're trying to prove here... I'm sure that the prosecutor's complaint is drafted casting the information available in a light most favorable to the state. I'm also sure that there is evidence/testimony that the prosecutor finds damaging, and said evidence will be omitted and left for Defense to uncover. Remarkably, the Defendant's testimony is largely omitted. Generally, this particular complaint spins a tale as told by the two survivors. Note that hardly any of the Defendant's own testimony is referred to in the complaint.
Surely when "the people on the ATV saw him and one man removed the gun from his shoulder" he was within his rights to defend himself. You probably don't think so.
Note further that hardly any of the Defendant's testimony is referred to in the complaint.
I'm not trying to argue that Vang is innocent. I'm pointing out that he is innocent until proven guilty. He will probably be able to raise self-defense on at least two of the six counts, on the information listed in the complaint alone. After his own testimony is offered, it may be more.
Also, note the abusive, racist treatment that Vang received to which the eyewitnesses admitted. All it takes is one juror to hang the jury.
The physical evidence in this case is a mess, and is a microcosm of the whole ordeal. This case will be a mess to prove either way. Anytime you're faced with a he said/she said scenario, it will be a crapshoot.

I agree with Quik on one point: Yes, Chai Vang has rights. As long as he's a citizen, he's got his Miranda Rights. I don't think he can get a fair trial though. At least not in Northern Wisconsin. They'll probably get a change of venue . I hope this whole shooting sparks a dicussion on landowner rights. I think tresspassers have been given too much freedom. For example, we have people that ride around on our land on four wheelers from time to time. If i put out something that would cause them to be injured or even die, I would be at fault and i could be arrested. Stiffer fines and/or jail time need to be added in tresspassing cases. Landowners need to be given more rights to protect their property.I consider somebody tresspassing to be the same as breaking into a house. It's somebody else's, stay out unless you have permission. Some people say they didn't know they were on the other person's land. There's a simple solution to that: buy a plat book. For those who hang stands on other people's land, I dont think the stands should be given back. The landowner has every right to take them. They're on his property. So why shouldn't they be his? People should pay the price of this.
Another issue that I believe should be addressed is Hmong hunting. Now, I guess I gotta have kind of a disclaimer for this:I don't mean that all Hmongs are bad hunters and are all tresspassers and law breakers, but they have their reputation as such. I think that Hmong hunters on public land need to be watched. Not like followed around or something like that, just have the warden stop by every so often to check their bag and licenses. I know about a mile from our land in iowa there's a large chunk of public hunting land. When squirrel season opens, the Hmongs show up. They overbag on squirrels and rabbits and even shoot birds. They camp out in the woods. We found a smoldering campfire and a campsite on our land from where they had been. These kind of things have to stop. Our neighbors have found them on their land hunting. One tried to tell our neighbor that he had gotten permission to hunt there. When told he was talking to the owner, he just kind of shrugged. This stuff has to stop.

Quicksilver, I would hazard to guess that you would hope that somehow Mr. Chai Vang will be aquitted of all charges. This of course would be due to the brilliant, and dilligant around the clock paralegal case work someone such as yourself will slave over into the wee hours to accomplish. Your labor will benefit both Mr. Vang and the silk suited legal media pimp lawyer you work for, and the pimp lawyer you aspire to be. At such time as Mr. Vang is released into the public, I think it would only be fair for one who believes so strongly in Mr. Vang's innocence, and the deceased victims oibvious racism towards Mr. Vang, to take it upon yourself to invite Mr. Vang into your own home and together embrace the true meaning of the liberalism you espouse. Court TV and CNN are hiring fine people like yourself. Good luck with your carrer, someday we will all be held accountable for the way we lead our life, for our actions, both good and bad, and our lies both to others and ourselves... There will however be no appeals process involved.
