This is not right....!!! I'm serious....Any animal that can be proven shot on your land should be yours....we need to change this law..

I cant imagine how it would feel to lose the excitement of this harvest and only have a trail cam pic...The hunter CAN Not judge how far the animal will run...that guy in the BMW needs to venture back to the city where he came from...I'm sorry..just my thoughts...He/She's not in the right frame of mind.

I'm upset about this.

Man that sucks....I have a few questions...

Don't game wardens have the authority to go on whoevers land if it involes "game" or hunting issues without a search warrent?

Aren't there "wasting laws"...shooting deer and leaving them lay?

You should have asked your CO "If I go grab that deer right now, in front of you, what's the worst you can do to me"? If he said write you up for tresspassing and that's it, then you could have strolled over and got it.

Tim, I feel horrible for you, but Im glad you didnt do anything to get yourself in any legal trouble. A zillion thoughts have gone through my head thinking about how I would have handled it, or what I would have done. I think your decision was probably the best choice you could have made although I cant deny in my younger days I wouldnt have just gone and got the deer, or had some kind of confrontation with the guy but at that point he wins as you are now having to legally defend yourself. This is just one of those situations we all dread as hunters. I'm really really sorry bro, its just a darn shame all the way around.

This is not true.

It happened to me 3 tears ago. When I was asked where I shot the deer I was honest and told the warden. When I was asked where I recovered the deer from, again, I was honest. I asked what was going to happen and the warden said they were going to confiscate the deer and give me a trespassing ticket. I then asked what they were going to do with the deer. He said that they were going to donate the meat to the needy and have the head mounted for their collection. I told him that they had better put the meat and head in a freezer because I was going to contest it and if I won, I was going to want the meat and head back. He then made some calls to his superiors and a little while later came back and told me that I could keep the deer. He also said I was still getting a ticket for trespassing. I got a lawyer and he got it thrown out of court before I ever made an appearance. It still cost me $300 for the lawyer though. [:@] The lawyer told me it was like if you were playing ball and your ball went into someones yard, you could retrieve it. This was in Ill.

Anyway, it cost me some money but I got the deer (12pointer) and no ticket.

Actually, Greg, you just proved my point.

Confiscation is their first move..You got lucky. Don Higgins had to plead guilty to trespassing, pay a 500.00 fine plus court costs and have six months supervision in order to get his buck back.

I don't think your point was proved. They never confiscated my deer. The land owner wanted the state to claim the deer because he couldn't. He didn't legally obtain (kill) the deer and the warden told the land owner that the state can't claim the deer.

The deer was killed legally so it was legally mine. The trespassing was a whole other matter. Nothing to do with hunting since I wasn't armed or hunting. I was "recovering" my property.
