waiting enough time is a big deal, shed have been dead right where you saw her. no even if you didnt see her get up and run (you didnt say) she probably took off at least a little bit after your encounter. my opinion the fine is worth killing the deer and a good warden probably wouldnt fine you if you showed that you gut shot the deer (show him the smelly arrow,etc.) give her time now and then go get her.
