I have a question about a law. I am always worried about this. If I shoot a deer on my land, and it runs onto someone elses land then can I go get it without their consent? And if they were asses then could they take my deer away from me?

To answer your question, No, you can not retrieve a downed animal on private property without the landowners consent. Yes, the landowner could take your deer if it is on his property if he or she so chooses...it happens all the time. Retrieval of game is no excuse for trespassing!

If it happens, tell the landowner what happened and I bet most times, he/she will grant permission to retreive your kill.

If this happens where I hunt and the owner won' t allow access we call fish and wildlife.They then go retrieve the deer.The landowner must allow the conservation officer to take the deer unless the landowner has tagged it himself.The landowner can' t deny access if he himself does not tag the deer as our law prohibits him from letting the meat of a big game animal from going to waste.This is seldom a problem since most people that do not allow hunting on their property do not have a deer license so they must let the deer be taken.

Stubblejumper... it is the same way in Fl. I have seen the Fish & wildlife officer threaten a landowner with arrest for willfully allowing ...I don' t remember exactly what it was for... but it worked!

in iowa, you can track deer into somebody' s land WITHOUT a gun. in wisconsin, i think it' s the same way. We' ve had one time that happened, and we called teh landowner who lived in IL, he gave us permission and we got the deer.

To clarify, in Wisconsin, gun or no gun, you CAN NOT enter someone elses property without their permission. Trespassing is ILLEGAL whatever the reason. Either get permission or don' t enter! Not trying to sound like a hard a$$, but I have had people come onto my property without permission, stating that they were only there to retrieve their deer. Had they asked permission, I would have gladly granted it, but to just enter my property without my consent is both rude and thoughgtless!!!

If you are the land owner I don' t beloeve you even need a hunting license to hunt your own land so the tag issue might be mute. #1Gamewarden where are you?

In some canadian provinces such as alberta you can hunt black bear on your own land without a license but you must have a license for deer,elk,moose etc.

Not too sure what the laws are here in Montana on game retrieve, but I do know that a homeowner DOES NOT need to post his land to keep tresspassers out as it is a persons responsibility to know where they are at all times while hunting/hiking. ect.
I live lin the middle of the Kootenai National Forest and my kabin is surrounded by forest, it is absolutely impossible to visit me without one tresspassing on my property, its pretty much remote but if a tresspasser were on my property looking for a deer that he had just shot, I guess it would depend on the individual(s) attitude. How in the hell could I ever deney a eager young hunter in persuit of his first deer?
But I will tell you one thing and that is if you came on my property and " TOLD" me your going to retrieve a deer that you just shot, you would have a serious problem and I would make you leave.
If in doubt, don' t ever take a weapon on private property, even in game retriveal.
Leave it at the gate/fence. ect.
