Caught a Poacher
Had a birthday party to go to tonight and was asked to go thru town and pick up some ice cream and decided to drive by a place where I see deer all the time on the way. I seen 6 does and fawns when I got there and noticed that one deer didn't get up. It seemed odd that the deer was laying on his side. So I decided to open the gate and drive in out of curosity. The deer turned out to be an 11 point that had been shot thru the neck.So I called the game warden and he said it would take him about thirty minutes to get there because he had arrested two lowlife spotlighters. I was to meet him at the intersection about half a mile down the road. I heard a door slam shut and a red Ford pickup came down the road. I went to see if the deer was gone and it was so I followed the pickup to the check station where this lowlife checked it in. I asked the man at the check station not to issue a carcass tag till the warden got there but he did. The game warden took a blood sample from the deer which was at the processing plant already and some out of the lowlifes pickup as well as blood where the deer was laying in the feild for DNA testing. He says that it is as good as gold. The warden also said that he has been after this lowlife for a while but has always been one step behind him. He seemed pretty happy as he thinks this time he has him . Oh yea the ice cream was a little late and soft but the birthday boy is only one year old so he won't hold it against me

Way to go Mod. In my opinion, nothing makes good hunters look bad like Poaching. Its usually wasteful, immoral, and of course illegal. And its our job as hunters to make sure that poaching is punished. I know it usually means we have to go out of our way to do it, but that comes with the job and is well worth the trouble. Kudos to you.

He shot a deer on my property without permission. He shot it from the road and out of a vehicle. He trespassed on my property when he crossed the fence to get the deer. He gave false info to the check station when he gave the wrong location of the kill. He shot it with a .22 mag which is not legal in Oklahoma. Thats what I call poaching.

i see why knobby asked these questions......
the lowlife was probably poaching. however if it is deer season in your neck of the woods, the guy checked the deer in and had it tagged w/a temp field tag on it, the check station issued him a permenant tag, all the blood work that the warden did confirms that the deer in the field that you found is the same deer that was at the processing plant, and no one saw him illegally shoot the deer. the worst that could come out of it is that the guy gets busted for trespassing, and thats if he doesn't have permission to hunt where you found the dead deer. its sad but thats how i can see that one playing out. |

oops sorry mod70 we were posting at the same time...i didn't have your facts when i posted.....looks like it was a job well done mod. keep up the good work...i just hate to see these guys get off on loopholes and we seem to see it every day.

nodose you are partially correct. In Oklahoma any time a deer is taken illegal there is also a charge called illegal taking of wild game. The fine for that is $600.00.If he trespassed that makes the deer illegally taken. Yes it is deer season and he did check it in but he gave false info as to what unit it was taken in and there is a fine for that. I didn't ask how much. I did not see him trespass and the warden took the .22 mag. I think he has a lot of trouble ahead of him.

did the game warden confirm that the deer was taken w/a .22 mag? that will play into the poaching equation. if the warden doesn't cover all his bases a decent lawyer is gonna have a field day. any poacher we can squash is a good thing for hunting but i have seen too often law officials getting caught up in the moment and being so happy that they got their man that they don't close the deal. if you know what im trying to say.

The game warden took the .22 mag at the time he talked to him and got the blood from his pickup. It was the only weapon in his pickup. This is the second poacher I've caught in two years and the warden handled the last one like a champ. I think the biggest hurdle is convincing the District Attorney that it is worth his time to press the charges and follow through.

that shouldn't matter....if ok is like ohio...you have to have written permission to hunt or even be on someone else's property. i think that a lot of states are going to this protocal because of all of the hunting leases that are popping up around the country.

Yes Dane the land is and was posted. I put up 35 new signs on 4 1/2 miles of road front in early October. That is in addition to all of ythe old signs that have been up for years. You can see at least two signs from anywhere you want to cross the fence. In fact I have had people comment that my signs are overkill.
Nodose is correct I don;t have to have any signs he knows he doesn't have permission. Actually the signs say "<center>No hunting or Trespassing Posted and patroled</center> |

Well I guess I will take some shots for this but!!! I think DNA Testing and all is a big waste of taxpayers money for a $600 deer violation. People with real crimes committed aganist them can't get thay kind of police help due to costs and the CO is using up public resources on a case he probably will loose. I also don't like vigilantees running around following people and playing cop. Just a perspective no personnel atack intended.

Great job! I'm glad you have a game warden that seems to care about the landowners for a change. With any luck the poacher will catch a few years jail time for his stupidity. Keep us up to date on the developments of the case.

Md: I farm for a living and farm about 600 acres. And then I have about 1400 acres of pasture. Not all of this land is in good deer country. The area in question is 320 acres on one side of the road, 160 acres on the other side. And the there is another 160 1/2 mile to the south. . Stubble jumper we think alike Thanks

Sorry nodose guess I asked for that. I Just don't like the 1984 thing. I think most of you are to young to fully understand what it is to get drafted and go to war for rights. may be this wasen't the best case but i just don't believe in people playing cop and turning in neighbors for any reason. How many of you know someone who does drugs of some kind DID YOU TURN them in. No why not its a lot worse crime than Poaching. No I don't sbreak the law and I don't sabuse others property. Before you slam someone walk a mile in his shoes!!!

just a thought, playing devils advocate here:
all mod saw was a deer on his property that had been shot and killed. mod didnt actually see the guy shoot the deer in his vehicle from the road with a .22, I have to admit that having the .22 on him is going to hurt his defense, unless he had another "legal" hunting rifle in his posession. and as far as him trespassing, it is possible that he shot the deer at another location and the deer ran onto mod's property and died. i know that if i had shoot a deer and it ran onto another persons property and died, i would feel that is was my obligation to retrieve the deer. i'll say that i would be angrier that someone left the deer to rot than seeing them on my property without permission. and last but not least. why wasnt mod out hunting? |

Hey Phil, there is a bunch of us on the forum that have military service, and I bet not one of us served to give a damm poacher the right to tresspass and illegally hunt. By the way, move in next to me and start the drug crap and you will be turned in quicker than you can walk a couple of feet in your own shoes.

Mod70 - great job! It's unfortunate that you have to go to such lengths to protect your property. Stiper Phil - I don't believe that what Mod70 did constitutes vigilantism. He didn't take the law into his own hands, and by his account he didn't confront the poacher. What he did do is see a crime and report it to the proper authority. I don't want this to sound like a flame, but I disagree with your viewpoint. You're take on this is not to play cop, but to play prosecutor. You decide which crimes deserve prosecution, which should be ignored. Sorry, but your arguement sounds like "I don't want to get involved". What if the poacher were trespassing on your property? Perhaps stealing from you? Shouldn't we pick up the cell phone and report it to the proper authorities. I think the indifference of good people to criminal acts is worse than poaching. |

eastwood: I found the deer dead from a high neck shot just behind the ear. I dont think the deer took one step after he was shot. The poacher claimed he shot the deer in another county. So it's not a case of not finding the land owner (me) to retrieve the deer. And why wasn't mod out hunting: I had already filled my buck tag and does wern't legal till Sat am.

Way to go Mod70. We've got poachers and trespassers on our land and I haven't caught them yet, but I've finally got family support to crack down on them. I know that the GW has other things to do besides patrol our place and that the primary responsibility rests with the landowners, but it's my inlaw's place and they didn't want to make any trouble with the "neighbors." These are the "neighbors" who have destroyed fences and equipment, and shot cows as well as helping themselves to the land and wildlife. My best blind has about 2 dozen bullet holes in it from over the summer. Are these the same people who some of us would protect by not turning them in? We put up signs and they tear them down if they pay any attention to them at all. For all of these reasons, I fully support what you did and I don't understand the thinking of those who would do differently.

Mod70, I think he was refering to a book published by George Orwell around 1950. The book, 1984, was about a Big Brother type of government. Don't remember a lot about it.

Although, I can see where the root of the problem is with this one. In OK deer are considered property of the land owner. If you shoot a deer on your property and he makes it to your neighbors property, you have to have permission from the landowner to retrieve the animal. If the landowner refuses you have to let it go. If you go get the animal you can be charged with trespassing, and hunting without permission. If the GW is notified that an animal is being left to rot I am not sure what they would do. Depends on GW.
I have hunted in SD and it is a law that the sportsman retrieve his game no matter where it goes. You can't take a weapon on the property but you must attempt to recover the game. |

I now that very scenario (Bob described) happened to a buddy of mine during a hunt. He called the game warden. The game warden proceeded to talk to the owner who would not let anyone in. He got nowhere with the owner. So, the game warden called a highway patrolman to the scene. Long story short, the highway patrolman dragged the deer to the fenceline to where it could be retrieved for my buddy. I don't know much about the legal rights of highway patrolmen, but I do know they need no search warrant to search a vehicle on a roadway. Maybe it transfers over to property as well.
But, the story is that I am sure there isn't a game warden around who wouldn't help out in a situation like this. There is always a way to get things done like that. |
