Default Magnification inconsistency?

I noticed the other day when looking at a buck through my scope that my Mueller 3-10x44 when on 10x has less magnification than my Alpen Apex 10x42 binoculars. Today I compared the Mueller to my Vortex 3-9x40, and again it had less magnification at 10x than the Vortex on 9x. It actually looks like 8x. Is this something that is normal to various scopes depending on objective size, or is this something that I should contact the manufacturer about? FOV for the Mueller is listed at 12.8ft @ 100yds vs 12.6ft @ 100yds on the Vortex, but the image was less magnified for the Mueller.
