Man charged for killing deer illegally
Updated: Monday, 26 Oct 2009, 4:54 PM EDT
Published : Monday, 26 Oct 2009, 3:48 PM EDTSARDINIA, NY (WIVB) - On Sunday evening Conlee Giboo, 24, of Cowlesville stopped his vehicle on Hand Rd. in the Town of Sardinia. His 5 year-old daughter was in the rear seat.
Giboo picked up his Ruger .223 rifle and, without leaving the vehicle, shot an 8 point buck which was in a field about 80 yards off the road.
Giboo then left the scene and was driven back to the deer's location by his wife along with John Wainwright, 27, of Holland NY. Giboo and Wainwright went up to the deer with a bow and Giboo stuck an arrow in its side in an attempt to make it appear that he had shot the deer with a bow.
But what he failed to observe was a hunter in a tree stand who had observed the entire incident. The hunter yelled out that he was going to call the police.
Both Giboo and Wainwright then ran into the woods and Giboo's wife drove away.
The witness called 911 and the State Police, along with New York State Department of Environmental Conservation Police, and Erie County Sheriff's Department responded to the scene in an attempt to locate the Giboo.
Giboo's wife returned later to pick up her husband and friend in a different vehicle but was stopped by State DEC Officer Chuck Wilson. The officer told her to call her husband on her cell phone. The two men then came out of the woods and surrendered.
Giboo was charged with endangering the welfare of a child, which is a class A misdemeanor and the following DEC charges: discharge of a firearm from a highway, illegal taking of wild deer, having a loaded firearm in a vehicle, taking a deer with the aid of a motor vehicle and in the field with a gun and bow at the same time.
Wainwright was charged with illegal taking of wild deer, in the field with a gun and bow at the same time and possessing a rifle afield during open deer season.
Both subjects were released to appear in Town of Sardinia Court on Nov. 10th.
