Delayed only means that he has to wait 3 days till he can pick up the firearm. Denied means that he can not purchase it. Here at Gander we make the customer wait 8 days.. just in case NICS calls back w/ a denied response. We've had NICS call back several daysafter the customer has picked upthe firearm (after the 8 days... only required to wait 3)w/ a denied response.. in which case the customer gets a visit from the authorities. But as long as he hasn't been denied.. then he should be able to purchase the firearm.

We have several customers get delayed all the time.. sometimes from their own records.. or for whatever NICS deems necesary. It can be something as simple as your name being similar to a felons.. or the phase of the moon for all we know. I've had customers get delayed time... get approved another time.. then get delayed the next time. Some time w/o ryme or reason. And some people get delayed every time...

If he is a felon no guns period....sounds like a lawyer would be a good place to start if there is a pardon and what not.

My attitude has always been, if a person has done their time, their rights should be restored. If a person cannot be trusted to own a firearm or vote, they shouldn't be trusted to live outside the confines of a cage, but I don't make the rules.

I had a friend (he died last fall) who had a felony drunk driving involving a child conviction many years ago.
He not only did his time, but matured greatly over the years. After waiting over 7 years, he appealed to a judge and was able to get his rights reinstated so that he could partake in the turkey and deer seasons.

I agree with Briman.
Maybe this will clear this situation up. Form 4473 question 11c -Have you ever been convicted of a felony (See important Notice 4 Exception 1) Notice 4 is sections for prohibited persons then exception 1 states that a person who has been convicted of felony or crime is not prohibited from purchasing firearm if 1. under law of jurisdiction where conviction occurred, the person has been pardoned (he has), conviction expunged or set asideor person has had civil rights (right to vote, sit on jury) 2. Person is not prohibited by the law of jurisdiction where conviction occurred from receiving or possessing firearms.

A friend of mine has been convicted of drug possesion twice and been convicted of assault 3 times. And he still can buy guns legally I was with him on his last hunting rifle purchase 2 years ago and he passed the background check with no hitches. I would have thought he would not beable to buy guns but apparently the ways the laws are he still can.
