I use Weaver rails on my Marlins, and 40mm objective scopes usually fit on medium rings without clearance issues front or back. I do have to remove the rear sight on one of my Marlin leverguns using medium rings at a 40mm scope.

You'll need to use the hammer extension piece though, it's an absolute pain in the @ss trying to cock the rifle under the scope without it.
