I'm not sure of the legality of that but, you may want to check your local game laws.I do believe that you are justified in your worries but I wouldn't let it discourage you.You are a hunter and are going to do just that.Like in all hunting situations nothing's guaranteed and just about anything could happen(for good or bad).You may actually benefit from this in ways such as,deer aren't always eating(especially during the rut) but, also that hunter might bump those deer to you on his way to his stand.It is said that deer won't bed down far from where they eat,that they'll eat alot then go lay down and chew their cud,but it may take only one encounter with this hunter to "push" these deer to you.They may even need to cross your property to get to his bait.Chances are that there are some nice bucks around and I'd bet that once the rut hits they'll eat quickly and be on the chase for their girlies.The more food energy they get should only be a boost for a fast paced rut,so be ready.Depending on the wind direction and the distance between yours and his stands you might be able to play his wind in your favor.I think you'll score this year.Let us know if you have any more questions.BTW I live/hunt in New York and have no experience with "baiting" as it is ILLEGAL here but am just going on what I know/think to be accurate.Good luck!!!!
