by looking at the topo map and photo, the hill was not steep enough to provide a good backstop fo anything fired. In my opinion, I don't think he is stupid, just failed to follow the main rule of thumb. Always check your target and whats behind it. I think that in the heat of the moment, he seen a deer, fired and didn't check the background. I also think that the landowner should have had no liability in this accident.
