Verbal permission in South Dakota. Around here there aren't too many problems though, most people know everyone, and know if it is okay to hunt on a particular piece of property or not.

A common misconseption in IL is that you have to have permission to enter upon a private property. True in the instance of a building but not land. Unless you have been told prior to entering upon that property that you are not welcome it is open game. One way to get around that is to post your ground clearly from all sides.

(720 ILCS 5/21‑3) (from Ch. 38, par. 21‑3)
Sec. 21‑3. Criminal trespass to real property.
(a) Except as provided in subsection (a‑5), whoever:
(1) knowingly and without lawful authority enters or

remains within or on a building; or
(2) enters upon the land of another, after receiving,

prior to such entry, notice from the owner or occupant that such entry is forbidden; or
(3) remains upon the land of another, after receiving

notice from the owner or occupant to depart; or
(3.5) presents false documents or falsely represents

his or her identity orally to the owner or occupant of a building or land in order to obtain permission from the owner or occupant to enter or remain in the building or on the land;

Ray,

Am i missing something here.Doesnt the Illinois regulation, at least in the hunting regulations booklet, specificically state that one is required to have permission to hunt on someone's land whether it is posted or not.

IL Conservation act does have a trespass rule but it is class b and a $75.00 fine.

So what they are referring to in the hunting regs is essentially a minor misdeamenor as opposed to criminal trespass?

That is the way I understand it. There was a guy several years ago who didnt have his property posted and threw a fit about a guy hunting on it. The CPO wrote him a trespass ticket. The guy paid $75.00 and didnt even have to appear in court. People we arrest on state statute must appear in court for a trespassing. We are all the time giving trespass warnings to people that way if they are caught on a property they dont get the pass go.

Didn't know the fine would be so cheap. But then again, there is an outfitter in my area who has all his ground (owned and leased) posted, but tends to wander onto other people's ground. He has openly bragged that it doesnt matter because he can afford the fine if he gets caught.

NH motto is "live free or die" and with NO sales taxes.
However we are considered the granite state, which says too me, we are rock heads...[&:]

~ Unless it's posted every 50' around perimeter of land, signed and dated every year it is not trespassing.
