He should be able to beat it with a good attorney but it will cost even if you win ,you lose .

What would they have done to a non-hunter? Bet it would have been considered self defense for them.

I would ask for a jury trial,and hope the judge and some of the jury members are hunters.

I am not a hunter I am a whitetail population reduction specialest

When I used to work with the Dnr call's would come in about someone shot a bear and almost every time we arrived the story was the bear was being aggressive or attacked them yet not a sign of attack anywhere,The thing is there has been so many bad bear stories that when someone see's one they think the bear will attack and either shoot it or throw stuff at it causing a attack.Bear are a curious animal I have been bowhunting and had one come right up to the tree I was setting in and look up at me now granted you start breathing a little faster but when I said hello that bear did 60mph to get out of there.The guy in the story maybe is telling the truth and was definetly affraid but I gaurentee not a lawyer,judge,or jury will see it his way because of no mark's on him or anything to prove the bear was aggressive even though the bear might of been close.

The guy did the right thing by calling the game warden. The warden did the right thing by writing him up. It's not up to the warden to assess whether this guy was in danger, that's up to the judge. The wardens don't make the rules, they enforce them. No one even knows if the guy is telling the truth.

I know of a old farmer up here in ontario & for him to shoot up to 20 bears a year.He call,s the GW,s & they tell him if they are bugging his livestock or to near his house to shoot to kill and go to there office or police & file as a livestock Killer complaint. Never has gotten in trouble yet what do you do when they come up to your porch when your having your evening tea & Cookies. I hope this guy gets off what,s worse a chewed up hunter or a area hunt for man killing bear.

Where was the bear shot? If the impact was in the chest - I would think that would prove he was upright at the time he was shot. THAT should make the difference in court.

On the other hand - I've come to realize that game wardens must have some kind of quota on tickets. Cuz' every single one I've seen, met, or heard about - had only ONE goal - to write as many expensive tickets as possible.

Personally, if at all possible - I avoid GW at all costs. I simply don't trust them.
