A brow tine is certainly counted as a point. as far as the broken tine as long as it meets the criteria to be a point than it would still be counted as a point.

As long as it is in good shape and there is sign around I would use it. We have a lot of 10' ladder stands on our lease and have never had any problems with spooking deer.
