I'm glad to see the judge allow this suit to go forward. This isn't about the women being place third in line. This is about the life of a child and she consented to this fact when she decided to have sex.

Alabama teenager to sue abortion clinic on behalf of aborted fetus

An Alabama teenager is suing the Alabama Women’s Center for Reproductive Alternatives on behalf of his aborted fetus.

A teenager in Alabama is suing an abortion clinic for terminating the life of his unborn child against his wishes. On Tuesday, an Alabamacounty court recognized the aborted fetus, "Baby Roe," as a plaintiff in the lawsuit, making the case one of the first of its kind, his lawyer said.

Ryan Magers, 19, of Madison County, claims his girlfriend got a medicated abortion at the Alabama Women's Center for Reproductive Alternatives in Huntsville in February 2017 when she was six weeks pregnant, according to legal documents, even though he urged her not to terminate the pregnancy. Alabama recognizes the personhood of a fetus, so Magers is suing on behalf of the fetus and himself.


“Baby Roe’s innocent life was taken by the profiteering of the Alabama Women’s Center and while no court will be able to bring Baby Roe back to life, we will seek the fullest extent of justice on behalf of Baby Roe and Baby Roe’s father,” Attorney Brent Helms said in a statement. “The time is ripe for consistency in Alabama’s jurisprudence: either we fully acknowledge the personhood of the unborn or we cherry pick which innocents we protect and which ones we trash for profit.”

Madison County probate court Judge Frank Barger allowed Magers to name his aborted child as a co-plaintiff in his case against Alabama Women's Center, a move that came just four months after the passage of an amendment that gave fetuses personhood, or the same legal rights as any other person, under the state constitution.

Helms believes the case could make it to the Supreme Court.


"I'm here for the men who actually want to have their baby," Magers told WAAY 31. "I believe every child from conception is a baby and deserves to live."

But the case has alarmed pro-choice activists.


On Twitter, Ilyse Hogue, the president of NARAL Pro-Choice America, called it a "very scary case" that is "asserting woman's rights third in line."

Others called it "unlawful and idiotic."

Personhood Alabama spokeswoman Hannah Ford told LifeSiteNews with the recent abortion debates after New York and other states have pushed for lifting restrictions on abortions, this case is a "timely reminder that every single abortion committed is a chilling assault on a precious and innocent human life – an intolerable violation of the most basic, God-given human right, the right to life.”

Great, it is about time the courts realize that a child is the product of a male and a female, and both should have a say in the future of the child. The child belongs to both. a life is worth more than property. In a divorce both sides are considered when it comes to dividing property. While a child is not property, it is a gift and one party should not have the right to decide the fate of the child. The first person to say that a fetus is not a child is an absolute idiot!

He does raise a point. Granting the woman sole decision-making authority for abortion upon demand takes away any rights for both the male and the fetus or baby. Filing this lawsuit places the abortion clinic into a deep pockets kind of financial risk which is what they are really worried about. From a pro-life standpoint, it's a brilliant tactic. :D

Given current laws, the only angle here is the fathers rights. Should the father have any say in the abortion decision. All other things are settled law unless we are going back to SC for that.

It is not an angle, it is a valid point. Should a woman chose to have a child out of wedlock you can bet the father is going to have to pay, he has no say in the matter. That should mean that he has a say in whether or not his child is killed! This is about men's rights for a change!

If you give the man the right to stop the abortion, are you also going to grant him the right to push for one?

True, a knife can cut both ways. But if you consider it logically, the men who are pro-abortion are already supporting women who want to have an abortion. The men who don't care or are AWOL are gonna stay AWOL. So any legal change or case law would really oinly affect males who are pro-life and foolish enough to involved with a pregnant female who is pro-abortion.

That was a pretty callus statement. It isn't about you or the woman, it is about a human life being snuffed out with no consideration by one person when it took two people to make the child. It is far past time for the courts to consider both people who have a stake in the child's life. If a woman doesn't want to have a child there are ways to prevent pregnancy prior to the fertilization of the egg. Once that happens, you made your bed, both literally and figuratively. Killing children for convenience is an abomination! To save the life of the mother is another matter. There have been mothers who chose their unborn child's life over their own, think about that.
