A little more information would be very helpfull. What caliber, any marking on it, proff marks, manufacturers name, etc.

the only thing i know is the local police dept said it was a 98k and i know its not. there are no marking other than the 4 didgit sn of 6676. That is found on the bolt handle, left side of the barrel and on the top of the reciever under the rear sight.

Not a 98K, maybe an earlier Mauser, looks similar to a British SMLE but I don't think that is what you have either. Hope it's not French!

French guns are THE EASIEST to determine, they'll have a white flag hangin from the muzzle and the bores will shine like new money because they were NEVER fired!!!

I guessing it's a Mannlicher of some sort, if you google Mannlicher pictures, you'll get quite a few pictures to look at.

That plate on the side of the magazine is very distinctive. Only place I've been able to find it is on a Mauser:
