Texas Question
 
Is it with in the law to carry a hand gun on a Texas lake, with or with out a C. H. Lic? A employee of mine got a ticket while fishing ( too close to the dam ) , and showed his CHL with his drivers and fishing Lic. when asked by a Game Warden at Lake Lavon. The game Warden took his gun, took him and his boat off the lake , and after they were off lake property he gave him his gun and a ticket back.
I told him I would ask.

This scenerio sounds a little fishy to me, and I think there is more to the story. I have had my CHL since 1995 and have never heard anything about not being able to carry on a lake. To make a very broad and general statement, every single Texas game warden that I KNOW are a**holes, and it sounds like your friend had a run in with another one.

Your friend should feel lucky that he got his gun back without a legal fight and should probably not go back to the lake with his gun in the boat.

This person would be the last person to adlib on the story. G.W. said no hand guns on Texas lakes. I have duck hunted there and many other Tx lakes, with out an issue over the shot gun. He goes to court Friday to pay a fine , they said it could run $500.00!! I'll keep you posted. I wish Skip McBride was still alive, he was a G.W. Commander, he would know.

Well $300.00 fine for fishing around dam, No charge for hand gun. You can not carry a rifle or hand gun on Lavon.

The water in Lavon (and Hubbard) are actually under City of Dallas jurisdiction. Game wardens can enforce game laws on there and since they are peace officers, they have a little more leeway on other issues but this sounds crazy. I have never offered it up to a GW while fishing that I was packing.

I have no personal knowledge on this matter, BUT the National Rifle Association/Institute for Legislative Action keeps a listing of all states' gun laws, and you can access them online! However, it is possible that the offenseis a violation of a Parks & Wildlife fish & game regulation, rather than of a state law. In which case, you would have to check out hunting & fishing regulations rather than gun laws. The appearance ticket he was issued would have to state what the law/regulation was that was allegedly violated, I think. He may be well advisedto consult an attorney before going to court.
