I agree..just amazing..some of you are just amazing. Tell your friend to get a lawyer ASAP. Pay the retaining fee and see what the lawyer can do. If he can, call around and find a lawyer that has had experience in cases such as his.
I got in some big time trouble and was thinking I had jail time but I called around, found the right lawyer and was able to get off with just probation because of her experience and history in a case of the same type. Whatever he does, don't let him go in without a lawyer, It will be like feeding a lamb to wolves. I hope he learned from his mistake and can move on with his life from there. Now if the cop or game warden or whoever just came up and stuck his nose in the yard to find out what's going on..isn't that searcha and seizure without consent? Or something like that. I know Game Wardens in some states are higher up than the law enforcement and can get away with it...how bout' you? Good luck buddy |

My question is, does anyone have any experience with this sort of situation (personally or by association), and is there a reasonable defense? The warden is calling him a "poacher", which I think is COMPLETELY out of line. I'd rather fill out an income tax forms than deal with all the BS they do up there. Top it off with a stink'n number posted on your back like a convict and is it any wonder a hunter is presumed guilty of tripping over some kind of red tape booby trap? |

I can tell you right now, that a lawyer may or may not help your friend's case. The DNR here in WI is the EXTREME for strict. They also like to make examples out of people that don't follow the rules by basically nailing them to the wall for as much as they can. It does look extremely bad for your friend being that he was called in by someone else. I really can't even imagine what kind of defense a lawyer could come up with for him being I think they even put in the regs....."Ignorance is NOT an excuse!"
I will say in your friend's defense though, that a person almost DOES need to be a lawyer to understand some of the twists and turns in the deer regs here in WI. As far as him not knowing that he was in an EAB unit, even if he didn't get a regs book, last time I looked, I thought all license issuance stations had a big map of the state's DMU's, and I've enclosed the link to the deer regs for here in WI.... DEER REGS WI I'd like to refer all to what would be page 36 of this year's regs. It includes the map of the state and it's DMU's. It ALSO includes a color coding system for what's what in all the DMU's, and I admit, you have to look pretty close at some of them. If someone really wants to have some fun.....feel free to read through the regs, especially some of the parts about tagging deer with this or that tag....it's a gas! Good luck to your friend. |

If he's not a muzzleloader hunter I can understand he didn't know all the laws about the special season.... but he had to know the laws about "Earn a Buck". YUP, he's in trouble and he knew it could happen. IF you're going to set yourself aside from the laws that everyone else has to follow.... you have to be ready to accept the penalties. All he can do is throw himself on the mercy of the courts and hope they don't take his hunting priviledges away.

The Game warden is your friend until he can get you for something. I'm sorry that I don't have any advice for you or your buddy. But it looks like he's screwed. I don't know why, but every year I read our regs front to back a couple times. A little hobby I started years ago cause I just like to know all the regs and know them off the top of my head without looking them up. Maybe I like to prove my buddies wrong when discussions come up around the camp fire...I don't know. Maybe your buddy should start doing that after he gets his hunting privaleges back. ;) |

With all the new laws that are passed every year you have to have a lawyers degree to make them all out and understand them. I recently called our main office and asked about bow hunting in A wildlife management area during muzzleloader season and got three different answers. The final answer I got was to get hold of the warden in that area as it was a "gray" area. Now what is a "grey" area when it says one thing in the book and another in the field. Some times it amazes me how the rules are changed at the spur of the moment....but the hunter is supposed to "know " all the rules....no exceptions.....:) I feel for the guy. I'd just go to court and tell the judge the way it was and hope he or she is "having a good hair day"!!!! And I'd for sure try to get my hunting gear back and hunting privligies reinstated again.

Well all I am gonna say is that is too bad, but he and every other hunter needs(ed) to know the laws to a T to keep situations like that from happening. Whatever sport you do it is imperative to know the regs.
