Second Regular Session Sixty-sixth General Assembly STATE OF COLORADO INTRODUCED LLS NO. 08-0462.01 Jery Payne HOUSE BILL 08-1096 House Committees Senate Committees Agriculture, Livestock, & Natural Resources A BILL FOR AN ACT 101 CONCERNING A PROHIBITION ON THE INTENTIONAL CONFINEMENT OF 102 ANIMALS FOR THE PURPOSE OF HUNTING. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Prohibits a person from offering another person the opportunity to hunt, wound, or take any mammal that is intentionally confined, tied, staked, caged, or otherwise restrained from engaging in normal movement. Allows exceptions for slaughtering a mammal for purposes of meat, leather, or fur production or humanely euthanizing a mammal for health, safety, or scientific purposes. Establishes penalties. 1 Be it enacted by the General Assembly of the State of Colorado: 2 SECTION 1. Article 6 of title 33, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 4 33-6-132. Hunting confined animals - prohibition - exceptions 5 - penalties. (1) IT IS UNLAWFUL FOR A PERSON TO OFFER ANOTHER PERSON THE OPPORTUNITY TO HUNT, WOUND, OR TAKE ANY MAMMALTHAT IS: 8 (a) INTENTIONALLY CONFINED IN AN ENCLOSURE, REGARDLESS OFTHE SIZE OF THE ENCLOSURE; OR 10 (b) INTENTIONALLY TIED, STAKED, CAGED, OR OTHERWISE 11 RESTRAINED FROM ENGAGING IN NORMAL MOVEMENT. 12 (2) NOTWITHSTANDING SUBSECTION (1) OF THIS SECTION, APERSON MAY: 14 (a) TAKE A MAMMAL AT A SLAUGHTERING ESTABLISHMENT FORPURPOSES OF MEAT, LEATHER, OR FUR PRODUCTION; OR 16 (b) HUMANELY EUTHANIZE A MAMMAL FOR HEALTH, SAFETY, ORSCIENTIFIC PURPOSES. 18 (3) ANY PERSON WHO VIOLATES THIS SECTION:(a) WITH RESPECT TO BIG GAME OR ENDANGERED SPECIES, ISGUILTY OF A MISDEMEANOR AND, UPON CONVICTION THEREOF, SHALL BEPUNISHED BY A FINE OF NOT LESS THAN TEN THOUSAND DOLLARS NOR 22 MORE THAN TWENTY-FIVE THOUSAND DOLLARS. UPON SUCH CONVICTION,THE COMMISSION MAY SUSPEND ANY OR ALL WILDLIFE LICENSE PRIVILEGESOF THE PERSON FOR A MINIMUM OF ONE YEAR TO LIFE. 25 (b) WITH RESPECT TO ALL OTHER MAMMALS, IS GUILTY OF AMISDEMEANOR AND, UPON CONVICTION THEREOF, SHALL BE PUNISHED BYA FINE OF NOT LESS THAN ONE HUNDRED DOLLARS NOR MORE THAN ONETHOUSAND DOLLARS, AND AN ASSESSMENT OF TWENTY HUNTING LICENSE3 SUSPENSION POINTS. 4 SECTION 2. Safety clause. The general assembly hereby finds,determines, and declares that this act is necessary for the immediatepreservation of the public peace, health, and safety. |

I don't like it. I donot and would not hunt deer on a game ranch, but I think there is a huge difference between fencing in an acre and shooting a deer and having a thousand acres fenced. In NY, the state would be in violation of this law. There is an old Army depot here (Seneca Army Depot) and the state holds a lottery for priviledges to hunt the 10,000+ fenced acres each year. It is home of the largest herd of white deer in the US (Google "seneca white deer"). Funny how the buddies of those running the lottery always seem to get selected. New laws won't change garbage like this.

I do not support high fence hunting.............but this just allows anti-hunters to get onestepcloser to taking away hunting from everyone, fenced or free range.

I don't like it, I wouldn't hunt at one ever. I just don't think it is right for the Government to intervene here. This is America and weather we like the idea of hunting fence's or not, It is there land and they pay taxes for it why should they be told they can't use it for said buisness.

Someone wants to fence in a large property it's not my buisness, I don't like it, wouldn't hunt it, never pay to hunt it but it's their land.
I do have a problem with what was going on where Jimmy houston shot his show where animals were being drugged. I really have a problem with people shooting tame animals or shooting when thay are literally in a cage. |

GMMAT, You ever seen video of someone shooting an animal in a cage or a drugged animal or one that staked. People on here talk about disrespecting a deer if you kill it quickly with a shot they don't agree with. This to me is disrespecting an animal and it's wrong.
The worst thing is that there are enough people willing to do it, to keep these places in buisness. |

They are animals......put here on God's earth to feed us. While I'd like to see every one that's killed......killed in a humane and ethical manner...... What's different (in the eyes of the pinheads making the rules) in killing one OUTSIDE that fence? You kill it the same way (hunted in or outside a fence line), ........don't you? |

THAT MAY NOT SOUND TOO BAD, BUT JUST LOOK AT THE NUMBERS REPORTED ON DEER GETTING OUT INTO THE WILD. IT HAPPENS EVERY DAY. WV IS TRYING TO MAKE FENCES HIGHER TO KEEP THIS FROM HAPPENNING. BUT JUST THINK, ONE STORM AND A TREE HERE AND THERE FALLING AND GUESS WHAT...CWD IN YOUR LOCAL DEER HERDS. CWD CAN GO ON FOR YEARS IN YOUR LOCAL WOODS BEFORE ANYONE NOTICES IT. Didn't realize over 20 states already have rules against canned hunting.
To clarify, I am talking about places that buy animals from zoo's release them in a small enclosure so some jerk can get a trophy, if anyone can tell me that's hunting then we are doomed. |

If its interpreted to mean confined within pen, caged, or staked so that it cannot escape I am for that. A few years ago Indiana got rid of the same. I am not for banning high fenced hunting as long as the animal can escape as in many many acres.
Doesn't matter much to me, Colorado is one of the best managed states when it comes to game animals. The Colorado DOW pretty well knows they are doing. |

Yeah, I would say; this is where it all starts…
But it started a long time ago, and this is just the next progressive step… I wonder what the next one will be? There's an Army base near me called Fort AP Hill. It has around 87,000 acres and has a hunting program. But since it is fenced... |

I think there are a couple of reasons why this is a bad law.
1) It said no hunting in ANY fenced enclosure....for those of you who hunt on cattle farms, are you willing to give up hunting in those areas because those are definitely fenced. 2) Who is the authority that decides that an area is considered "fenced"? Those two reasons above are very important. |

I think the problem with this bill, is that like most, it is filled with propaganda to exploit the public and sway a vote from uninformed voters.
I think we’d all agree that shooting an animal in a cage isn’t hunting. But where do you draw the line on size of property that is fenced? And how do you define fenced? Three strands of barbed wire with openings? Three strands of barbed wire with no openings? 4’ chain link? 6’ chain link? 8’ chain link? 8’chain link with three strands of barbed wire? White picket fence? As posted above, Fort AP Hill has 87,000 acres. I haven’t hunted there but I’ve driven past two sides of it (route 17 & route 2) and they both have 8’ high chain link fence with barbed wire on top. Given the size of the property, I wouldn’t call it canned hunting. But some of you may… Maybe I should join next year… only $50! |
