am i reading this right? re: PA laws

page 32 of the license book says

"It is unlawful while hunting or preparing to hunt to 1)damage any tree on public or private property by constructing a treestand or using a portable treestand or device to climb a tree;"

Does that mean climbers are illegal on public land, or that you just can't damage trees? I know it's a stupid question, but with the way that's worded i just can wrap my brain around it.

I read it as if it means illegal to damage, but not to use a stand. Is it verbatum, the language from the reg? I ask, as last time I checked if I own my own land I can damage my trees as I see fit!

yes, that's as it appears, but there is a second section that says "This does not apply to landowners constructing stands on their own property, or persons who have received written permission from a landowner to build or use a treestand." I understand that part....just section 1 has me baffled.

i believe the law reads you cannot damage the cambian layer of the tree, which is underneath the bark. trees like red maples and such damage very very easily...i wouldnt recommend climbing them. i usually only climb oaks or other thick barked trees. i also stay away from cherry and other such trees that have loose ragged bark that breaks off easy...not technically doing damage..but im sure they can say you did, and it gives away your spot. you cant tell when i climb oaks and such most of the time.

just take out the extra words and i see "It is unlawful while hunting or preparing to hunt to 1)damage any tree on public or private property by using a portable treestand or device to climb a tree;"

The way I read it, having permission is the key.
