I would have to do the ethical thing, and not shoot him. Its bad enough to be in that situation, what you could do is go to the landowner that the land is on and just ask him if you could hunt on his land. I pretty sure he would probably let you unless he knows that deer is there too. I would just let him be, and even if you hunt there gun season you could ask the land owner so you can hunt on it then too. That way you get the best of both worlds.

Poaching is Poaching if i ever shoot a 180 class buck its goin on the wall and i wouldnt be able to look at the buck everyday and know that i didnt kill that deer fairly i poached it, so i wouldnt shoot.

A better twist to the question would be to say that the other side of the fence is posted. Too much gray area for some folks in some areas.

Been there... the biggest buck I've ever seen in my life, chasing does in the middle of a cut corn field, 60-70 yards away. A piece of cake shot with my Contender. Only it was my neighbors field, and I hadn't asked him about hunting on his land in a few years. We're fairly friendly, and he's always said "no problem" in the past, but since I hadn't asked in a while I didn't shoot. I did try my hardest to will him over to my side of the fence though. 
As fate and irony would have it... The next year someone who DIDN'T have permission to hunt where they were, killed that buck monster right on the path that leads to my tree stand.
