I can't believe that guy won't let you get the deer!! Maybe someday he will come to his senses. I know it does help now, but after a deer steps out into the road and he nails it causing thousands of dollars in damages, he may rethink his stand on hunters. It is a perfect example of uneducated people who know NOTHING about hunting and what it stands for. Good Luck.

This is one situation where I condone violating the law and any hunter's code.

If you can do so without damaging property and/or getting shot, go retrieve that deer. A trespassing fine is a minor consideration.

If you were to challenge the citation in front of the right judge, and you expressed that your ethics and consideration of the animal subordinated the trespass issue, the judge might dimiss the ticket.

What a jerk!
He may not agree with hunting or want hunters on his land, but to keep you from recovering a deer that is already dead is wasteful and ignorant. You did do the right thing by asking first. Very sorry to hear that he doesn't understand us yet.
It's your choice whether you want to cross the line of going in after in without permission, but I certainly wouldn't fault you for complying with the guy's wishes.

Wow! I'm amazed at this guys lack of information and ethics. He'd rather allow the deer to rot than allow you to go remove it from his property. Maybe the carcass will attract several coyote that will move on to this guys cats then a ton of crows that will defecate on his car. <img src=icon_smile_wink.gif border=0 align=middle>

I'm tempted to tell you to go get it regardless but then we'd be stooping to his level.

You did the right thing and it will come back around to you 3 times 3 (as the saying goes).

The DEC won't step in and accompany you onto the property to retrieve the animal??

I think that's the most disturbing aspect of your story---here in CT we're instructed to ask permission, and upon denial to call the DEP who will send a warden to accompany the hunter to retrieve the downed animal.

I agree. Go get the deer. I am a landowner and understand how the landowner probably feels about tresspassing. But I am also a hunter. See how that landowner would feel about his property taxes if all the hunters didn't buy licenses and tags. And if you do get caught tresspassing, I'll bet you could argue humane treatment of game animals and get off, or at least get to plead 'no contest'. Good luck and keep us informed as to what happens.

I echo Nick's comments. Is it possible for the landowner to see your flashlight at night? If not, I'd be ready to go in at dusk.
It almost seems, after rereading your post, that you have a visual on the buck laying dead on the other guy's property. Is this true? Shouldn't be too hard to get it out of there under the cover of darkness if this is the case. Hell, I'd drop a bunch of cow bones where the deer was and if he confronts you, tell him the coyotes must have ahd a good dinner.

That guys is a real idiot . I would probaly jsut go back at dark tongiht without a flashlight or nething if you know where the deer is down and jsut get it then. just be catious and really sneeky aobut it and then you will get your deer. It doesnt sound right but I would personally rather sneek on someones property for 15 minutes then kill a deer for no reason and just have it go to waste. So use your best judgement.

Scott, I agree with the others. You did the right thing for the landowner by asking permission. Now you need to do the right thing for the animal and go get him. You said you know where it is, so if you can wait until dark and go in with no light and get him.

well considering all the illegal tresspassers out there it makes me wonder! I would feel bad in this situation but there is other ways and hopefully if taken action upon IMMEDIATLY the situation can be remided both the animal goes bad! If not, 2 wrongs dont make a right and however bad we think it is to leave a deer, tresspassing is something I dont care to deal with, bars never did look good on me and I am sure that can be said for most of yaz!!!! Just something to think about.......

I am not 100% positive but I believe this topic has come up b4 in discussion with a game warden.....I think in Ohio the landowner can tell you AND the game warden to stay the hell off his property if he wants to

it really is stupid if you ask me....there should be a law in every state allowing law enforcement to recover downed game when the need arises

sounds like the idiot might just hate hunters so much he will stake out the carcass and watch for you to try and get it

In Kansas you have the right to recover game on any property and if the landowner won't allow access, the game warden will intervene and retrieve the animal.

If you decide to go after the animal . . . PLEASE do not go alone. Others with you could be the wisest thing you could do. More individuals that witness and support your ethics takes it out of the &quot;He Said-S[H]he Said.&quot; One or more additional whitness' would be priceless.

If the land orwner takes the deer . . . I would think he could be charged with illegal posession . . . unless he can get a tag.

I'd still call your local game warden and explain what happened. It can help with a few things. 1 - It will get your game warden familiar with this landowner. 2 - The warden can pay him a visit and see if anything is out in the open that shouldn't be. 3 - It gives you the opportunity to discuss what you should do in the future should this ever arise again.

Now, a couple of questions/assumptions.

Don't all game wardens have access to private land? I thought that was the agreement - that they protect all the lands, not just public lands.

Can a warden intervene and move the deer from one property to another?

I'm betting the farmer doesn't hate hunter's that much. What are the odds that he's enjoying some nice deer steaks right now?

Call the Warden...

call your local ECO, or being its after hours the troopers who can reach them via radio! I did some calling and left messages....well see what happens, hopefully ya dont loose it! But DONT BREAK THE LAW getting it back!

The biggest buck I ever shot ran onto neighboring property. It was a GIANT 10 point that probably scored 150-160 P&Y. I called to ask permission and was first accused of hunting on their land. Then they asked where it went and I told them. They then told me I <u>could not</u> go after it. I later found out that the caretaker went after it, found it and checked it in as his own. All of this was verified as truth by the landowner's son who I met years later. He wasn't involved at all, but knew what had happened.

Today's small bucks are tomorrow's trophies.

So how big was the buck anyhow???

Dave....man that's a bummer. You gotta be pretty pathetic to take a deer you know you didn't get and claim it as yours.

I've never run into that problem before...hope I never do...but it's definitely got me thinking.
