I can't believe that guy won't let you get the deer!! Maybe someday he will come to his senses. I know it does help now, but after a deer steps out into the road and he nails it causing thousands of dollars in damages, he may rethink his stand on hunters. It is a perfect example of uneducated people who know NOTHING about hunting and what it stands for. Good Luck.

This is one situation where I condone violating the law and any hunter's code.

If you can do so without damaging property and/or getting shot, go retrieve that deer. A trespassing fine is a minor consideration.

If you were to challenge the citation in front of the right judge, and you expressed that your ethics and consideration of the animal subordinated the trespass issue, the judge might dimiss the ticket.

What a jerk!
He may not agree with hunting or want hunters on his land, but to keep you from recovering a deer that is already dead is wasteful and ignorant. You did do the right thing by asking first. Very sorry to hear that he doesn't understand us yet.
It's your choice whether you want to cross the line of going in after in without permission, but I certainly wouldn't fault you for complying with the guy's wishes.

Wow! I'm amazed at this guys lack of information and ethics. He'd rather allow the deer to rot than allow you to go remove it from his property. Maybe the carcass will attract several coyote that will move on to this guys cats then a ton of crows that will defecate on his car. <img src=icon_smile_wink.gif border=0 align=middle>

I'm tempted to tell you to go get it regardless but then we'd be stooping to his level.

You did the right thing and it will come back around to you 3 times 3 (as the saying goes).

The DEC won't step in and accompany you onto the property to retrieve the animal??

I think that's the most disturbing aspect of your story---here in CT we're instructed to ask permission, and upon denial to call the DEP who will send a warden to accompany the hunter to retrieve the downed animal.

It's a tough spot. However, it'd be tougher for you if you were arrested & fined. This guy sounds like the type to press the charges to the limit.

I agree. Go get the deer. I am a landowner and understand how the landowner probably feels about tresspassing. But I am also a hunter. See how that landowner would feel about his property taxes if all the hunters didn't buy licenses and tags. And if you do get caught tresspassing, I'll bet you could argue humane treatment of game animals and get off, or at least get to plead 'no contest'. Good luck and keep us informed as to what happens.

Call the game warden and explain to him what happened. He should be able to go and get it.
