something to think about
i know this isn't a ml question but we all like hunting. my family and i farm in Iowa. i just want to ask this question. would you get mad if i went to your house without your permission and watched the superbowl on your big screen TV and drank your beer and had 10 or more friends with me???? well if you have ever trespassed i hope you don't get mad because this is the same thing in my opinion!!!!!!!we don't lease our ground out. but we let people hunt that ask permission. we are thinking of shutting down all the hunting on it just because of the pieces of crap that don't respect private property. well i had to get this off my chest. just remember hunting on private property is a privilege not a right.

Your comparisonof trespassing and watching TV in your home without permission is rather strange, but I understand your frustration and your point. Being a landowner my self, I have gone though the trespassing problem all too often. The problem is there are people out there that have no respect for private property, property ownership and in reality, our criminal laws. Granted, everyone wants the perfect hunting spot. The problem is, due to the private ownership and criminal laws of the land this is not always possible. Some individuals just do not, or refuse tounderstand this.
On the farms I used to hunt, we were always confronted with groups of hunters that wanted to make drives of the corn fields and wood lots in an attempt to drive deer off the property to were they had their hunters. I am guessing that is what you encountered. Many times they would simply climb the fence and hope they were not caught or confronted before they were able to make their drive. Confrontations with them can get very heated as I am well aware. Even physically dangerous on some occasions, so be careful. Your best weapons are a camera, cell phone, and above all to remain calm. I order them off the property, tell them that I will be taking pictures of them, and that I will report this to the Department of Natural Resources and the authorities. In Wisconsinwe do not even have to post the property anymore. The State declared it is the responsibility of the hunter to know where they are and who's property they are on. They love to tell me they saw no signs. |

the reason i use that comparison is both are criminal trespassing. the only diff is if in the house they will also get you for breaking and entering. its the only thing i could think of that a person that doesn't own land could maybe relate to.

NY has the same law. It's your job to know (although it seems vitually all land is posted in NY now-a-days).
Of all the crimes and violations a hunter could do or make I get the feeling too many feel trespassing is harmless. These same "hunters" (not!) may get all upset if they hear someone is hunting over bait (also illegal in NY). Or if one shoots from a car, or across a road, or before/after legal hunting hours, or taking game out of season etc. But they think a little bit of trespassing is "OK". You can't cherry pick your violation and condemn others for theirs. Let's continue to obey all the rules...and condemn others for any violation! |

yes it is posted. but most of the signs never make it threw the hunting season. they get shot up or taken down. in iowa you dont need to post it to be criminal trespassing.

Actually in NY you are required to post your property every 600 or 660 feet and on all coners to get a criminal tresprass conviction from whatI read. Mininumto press charges is on all corners. Hunters are supposed to have written permission but to convict on non posted land is impossible. Criminal trespass is a felonyif convicted and you to loose your civil rights too. That would be ugly... I have had pretty good luck getting to hunt numerous pieces of private land and always are allowed to bring a guest except on one piece. I feel your pain rockyshamrock. I just hope you don't kick off the good to rid the bad. Make sure what ever rules you make your guestsKNOW and expect them to help police your land. That would help solve that real quick especially if you give them permission to call the your game officers on your behalf. In fact I would guess most if it would end in one or two seasons and the "word" would be out... IMHO. Steve |

No I understand your point. It happens to me as well.
I still laugh about the one person I caught in a tree stand in the center of my property not more then 100 yards from my tree stand that he did not know about. When I confronted him, he told me he had permission from the owner. So I asked him the owners name and he did indeed know my name. Then I asked him if he had it in writing. He told me he did. So I asked if I could look at my signature on the note as he had my attention now since I never issued any written permission. He then confessed that he really did not have permission but was told by a neighbor that I did not care. So I asked him the neighbors name, but he did not know it. So I told him to climb down, and while he was getting down out of my tree, I took a picture of his back tag, wrote it down, took a picture of his face, and then told him I was calling the sheriff's department. The person got very angry at first with me. Even told me that he wanted me to delete the digital pictures I took of him, as I did not have his permission to photograph him. I just smiled and said that the pictures would be the evidence at his trial. So I told him he better start walking off the property... he then called me some real choice names and stormed off. |

Comparisons are great. I like to imagine what people are thinking when I stand out on a pier or in my boat and watch people toss cigarette butts into the water. I eat fish I catch from that ocean and inlet. Do you think they'd feel the same if I went into their fridge and dumped my garbage?
