I think your brother was very considerate in the way he went about this. I would have left the dog, called the law to have the dog checked for rabies and let the police tell the neighbor to come and remove the dogs remains from my property. I don't think that guys suit is going to stand even if your brother didn't have proof of the bite the dog was running loose on your property.
