I don't know which member you're referring to but the final decision honestly would not be made solely upon any PM or complaint you may have made. Members are generally not banned for a single post or complaint. The vast majority of members who violate the rules are gracious about accepting responsibility for a violation and correct the problem without any need for a ban. If a member sports a crappy attitude,continues violating the rules and refuses to correct the problem, he/she would then likely face a ban. Often, the same people facing a ban have been violating the rules in other forums you may not know about and refusing to correct the problem in those forums also. As you can see, there really is a lot more to the process than a single complaint or PM.
On your freedom of speech comment, it is true that our constitution does guarantee freedom of speech. HNI, however, is a privately owned website and clearly reserves the right to edit or delete posts and ban members who continue violating the rules. This isn't always popular but HNI does not wish to be sued or imply support of posts that clearly violate our rules and family friendly atmosphere.
