Can Idaho County Use RICO Laws To Stop Illegal Workers?
CANYON COUNTY, IDAHO 2005-04-18 - An Idaho county wants to try a novel and controversial legal tactic to fight illegal immigration. Oficials are considering putting a federal racketeering law to go after businesses that hire undocumented workers.
From farms to construction sites, there's strong demand for seasonal labor and plenty of temptation for businesses to hire undocumented workers.......
Brad Tracy owns a small concrete business. He claims competition from firms that hire illegal workers drove him out of the market for residential work.
Brad Tracy: "How can I compete? It's not apples to apples, it's apples to grapes and grapes to peaches, and nothing's on an even playing field.
Complaints like this have Canyon County officials looking into a novel idea: use a federal law designed to get gangsters and root out corruption to sue the companies that hire illegal workers.
Brad Tracy: "Oh, I think it's great. If you get some of these developers and builders and subcontractors that are knowingly using illegal immigrants, and you watch them get thrown in jail -- hah! -- it'll be done overnight."
The county has hired a Chicago attorney to determine whether the approach is viable.
Howard Foster specializes in RICO -- the Racketeering Influenced and Corrupt Organizations Act.
He's used RICO in cases where workers and businesses have sued over the hiring of illegal workers. But what Canyon County wants to do is something new -- a local government suing to recover damages such as the cost of indigent medical care.
Howard Foster: "I don't believe that a governmental entity has used RICO before actually as a plaintiff, and I am certain that no governmental entity has used RICO in this way to try to recoup costs caused by illegal immigration."
This legal tactic is the brainchild of Canyon County Commissioner Robert Vasquez, who has made a name for himself by going after illegal immigrants.
Robert Vasquez: "First of all, it isn't immigration, it's an invasion of illegal aliens."
