Former Little Leaguer Sued
STEPHENS CITY, VA - In baseball its three strikes and you`re out. But for one former little leaguer, a fly bat is coming back to haunt him.
For Alex Nguyen and Carol Boyd, it started like most little league Saturdays.
Nguyen was down on the field and Boyd, in the stands watching her daughter`s softball game.
But an honest mistake that happened that day cost Boyd her health and could cost Nguyen $200,000.
18-year- old Alex Nguyen started playing baseball when he was five- years- old. Trophies and baseball cards are all over his home. But these days he remembers one rainy game specifically, April 13, 2003.
"I got the pitch, I swung and when I was in my backswing, the bat slipped out of my hand," said Alex Nguyen.
The bat flew into the stands of another nearby game and hit Carol Boyd in the back of the head.
"I felt real bad. I didn`t mean for that to happen at all. It was an accident," said Nguyen.
Nguyen said officials stopped the games. Boyd left in an ambulance.
"I heard she was in stable condition. She just had a couple of stitches, nothing after that," said Nguyen.
Boyd`s attorney`s filed a lawsuit against the Frederick County Little League and former little leaguer Alex Nguyen for $200,000.
Neither Boyd nor her attorney would speak with NBC 25 on camera, but in court filing documents. Boyd said she suffered serious and permanent injuries as result of the accident.
She claims lost wages and wants to be reimbursed for past and future hospital bills.
Alex"s mom called it frivolous.
"It`s ridiculous. It"s been two years. He was 16 at the time. It"s the first time, he`s ever had anything like this happen," said Nguyen"s mother Gail Lewsader.
Frederick County Parks and Recreation cosponsors the county`s little league, simply by offering these fields for play.
They would not speak with NBC 25 on camera, nor talk about this case specifically. But, officials point out they offer adequate backstops and fencing to protect players and spectators.
Park officials said they have no plans to change the fields, but Alex`s mom thinks this suit will change the game.
"Everybody`s gonna be on their guard more than the relaxed feeling you get when you`re at the ballpark," said Lewsader.
Nguyen has not yet been officially served. His interview with NBC 25 was the first he`d heard of the suit.
But Nguyen`s mother said she`d spoken to Boyd`s attorney, Peter Burnett.
She said Burnett called her home to discuss the case, but he said he was a claims adjuster.
