Default 2 for 2 on suing my ex boss

He fired me and didn't want to give me unemployment. I won the case over the phone. Because I have kept busy with sub teaching and watching a foster child occasionally on the weekends I have claimed little unemployment pay.

He also withheld 150$ out of an October paycheck and I won that case in small claims. I didn't know I could have taken him for twice what he took out.

The guy is a jerk when you get on his bad side, but was decent when on his good side.

Employers routinely try to deny unemployment,

RARELY do they win. They just hope that you're not going to fight it.

They did that to me on my last job, I proved a a felony and a judge gave them a little "tinkle"on the phone.. he he.

They did get away with denying me about $20,000 in severance, but they can keep it, they're worthless crooks anyway.

i had a job about 10 years ago working for a company that was contracted to keep track of unemployment data by large comapnies...we'd track their payroll and things of that nature...

one thing i learned, that i did not previously know, is that people are only supposed to be eligible for unemployment benefits if they are unemployed through no fault of their own. a person who gets fired for stealing, attendance problems, insubordination, etc. is not supposed to be eligible. unfortunately, rather than fight abusers of the system, the companies will usually pay, because they get off cheaper in the end.

thats not true anymore. Substance abuse, fighting etc. are all now regularily denied unemployment.

Funny you should mention "insubordination" because thats what the company charged me with, and didn't have one shred of evidence and didn't even show up at the hearing.

"insubordination" is a catch all for "we're a bunch of crooks and we don't like you".

granted, it can be abused...but any supervisor worth their salt will document the incidents which led to the dismissal. if they don't, they've opened themselves up for a challenge.

Famous last words. So many supervisors simply aren't worth their salt. Many create problems where they don't exist and end up costing the company $$$$ just to back an incompetent supervisor.

My current boss is the only competent supervisor i've ever had in engineering. The rest weren't even engineers and were only interested in their own careers.

If this guy canned me, I WOULD feel bad because he's a good guy. The rest can bite me..

I had an employer that thought he had an iron clad non compete contact for salesman !!! He found out wrong then the court ordered him to pay me back all the commissions I had earned. Then after the court order, he still did'nt want to pay me , so we put a lein on his bank account .... he finally had to cough up, when he was trying to sell his house, the banks wouldn't let him close on the house until my lein was payed up !!

You do realize that "non competition" clauses are non-binding in Wisconsin?

The only one they can nail you on is their own information. As an engineer if I took knowledge of a patented product/process from one company to another, and they could prove it, i'm dead meat.
