LOS ANGELES "“ Jurors who acquitted actor Robert Blake of murder demanded an apology from District Attorney Steve Cooley who called their decision "incredibly stupid."

"I'm just disgusted," Blake jury foreman Thomas Nicholson said Thursday. "It appears to me he has no faith in the jury selection. After all, it was his people who helped choose us."

Addressing reporters Tuesday, Cooley defended the prosecutor who lost the Blake case and said he was stunned jurors found the actor not guilty of killing his wife and of one count of soliciting her murder.

The panel deadlocked on a second solicitation charge that was then dismissed by a judge.

"Quite frankly, based on my review of the evidence, he is as guilty as sin. He is a miserable human being," Cooley said.

Cooley stood by his comments Thursday night before he attended a gala hosted by the University of California's La Raza Law Student Association.

"There was a failure in this case. It was not my prosecutor. It was not the work of LAPD. It was the jurors didn't quite get it," he said.

"It was harsh. It was blunt, and I could have phrased it differently, but bottom line it was the wrong verdict. Sometimes jurors should be held accountable for their mistakes."

Other jurors who deliberated nearly nine days said Cooley's comments were unfair.

"If Mr. Cooley ... thinks there was enough evidence to convict, then he should spend more time doing his job and less time trying to make excuses," said juror Roberto Emerick.

Professional rules of conduct bar attorneys from certain public statements that are likely to "materially" prejudice a pending case. Another regulation prevents a lawyer from asking questions or saying anything to jurors that would harass or embarrass jurors or otherwise influence their future service on another panel.

Kathleen Beitiks, spokeswoman for the State Bar of California, said the organization could not confirm or deny if it fielded any complaints about Cooley's remarks.

Attorney Mike Gerner, who specializes in defending lawyers accused of professional misconduct, declined to discuss Cooley's comments but said it was critical for lawyers to be mindful of conduct rules when trying high-profile cases.

Loyola University law professor Laurie Levenson said Cooley's comments were a major lapse in judgment.

"I can understand why his office is frustrated," she said. "But it's much more of an embarrassment for him than the jurors."

Cooley also touched on the upcoming trial of Spector, 64, who is charged with murdering B-movie actress Lana Clarkson in early 2003. He has pleaded not guilty and is free on $1 million bail.

Cooley said prosecutors would tell jurors of Spector's "sex, drugs and rock 'n' roll" lifestyle.

"They think they know these celebrities," he said of jurors in general. "They think they know Phil Spector."

THATS THE FRICKIN' PROBLEM. JURIES are for the most part IDIOTS.


I have NEVER been asked to do jury duty.

I can't wait for the day that I am asked. I'm going to wear a tie made of rope tied in a noose.

I was on a medical malpractice jury once. The exact kind of frivolous suit we rail against so often here. I'll be glad to share if you're interested.

Do I think Blake killed her ? Hmmmmmmmm. I think its more likely he managed to pay someone to do it. I don't hink he did it himself. But even the circumstancial evidence was so weak the jurors couldn't convict.

And nobody liked that ex-girlscout slut of a wife he had anyway.

OK, it was about 6-7 years ago, so I'll recall what I can from memory.

Was in DC Superior Court--the trial took two weeks. The mother of a hospital patient sued the hospital after her adult daughter died in said hospital. The daughter was bedridden due to her morbid obesity and had several related medical conditions (pre-diabetes, high blood pressure, low energy, etc.) which were well-documented over the years. She was on welfare and lived with her mother while raising her own illegitimate child.

Now the daughter had been in and out of the hospital several times due to complications arising from her obesity. The last time she was admitted because she was physically ill and was suffering from lethargy. After several days in the hospital, she suddenly had difficulty breathing, panicked, and fell out of her gurney. She died several minutes later.

It was interesting to note how race played a part of this trial, but I'll get into more of that later. I'll start out by saying it appeared like something out of a movie. The poor (literally), grieving black mother and her black lawyers vs. the white hospital administrators, white doctor of the dead daughter, and white lawyers (technically one was Jewish).

The cause of death of the daughter was asphyxiation due to a pulmonary embolism (blood clot in her leg broke loose and got caught in one of her lungs).

The mother's case was that the attending doctor negligently prescribed numerous drugs that led to the death of his patient. I don't remember all of the technical details, but her laywers made two outstanding claims: 1) that the heparin in her IV heparin lock thinned her blood, thus causing the clot to release; and 2) that Compazine (given for nausea) also thinned her blood.

The thing is that she had never experienced a blood clot and was never diagnosed as at risk. However, she had been bedridden for several months before entering the hospital that last time and formed several clots in her legs.

It turned out that the heparin lock didn't actually contain heparin like in the old ones--the name stuck although the technology changed. Then it turned out that the woman never got Compazine because she was already diagnosed with high blood pressure, thus contraindicating the prescription. She received an alternative instead.

Basically the defense ripped a massive hole in the plaintiff's case, and the mother's lawyers basically pulled a datamax in court trying to overcome their deflated case and faulty logic.

So we in the jury deliberated for over 8 hours because the black half wanted to find the hospital guilty of malpractice, while we whites saw no basis for that. Finally we got it through everyone's head that the woman was fat and died of her own fatness. Ruling for the mother would've taken a big chunk out of the hospital's pocketbook and it would've ended the doctor's career just a handful of years after it really started.

I'm assuming of course then based upon what you typed, the turd didn't get a penny?


If that was in Milwaukee she would have gotten 300 Billion dollars and the doctor to wipe her arse.
